Law no 12/2014 Artigo 192 (4) (Contencioso eleitoral).

The appeal must be done in 48 hours from thepublication of the electoral results, by the in District Judicial Court or by the Constitutional Councilin case of the national or general tabulation.

During the electoral period, which runs from thebeggining of registration until the validation of electoral results by theConstitutional Council, the District Judicial Courts shall attend and judge theelectoral complaints contemplated in the electoral law with urgency andpriority”.

Durante o per?odo Eleitoral, que decorre do in?cio dorecenseamento at? ? valida?ao dos resultados eleitorais pelo Conselho Constitucional,os tribunais judiciais de distrito devem atender e julgar os recursosdecorrentes dos contenciosos eleitorais previstos na lei Eleitoral com urg?ncia e com prioridadesobre todo o expediente do tribunal”

TheDistrict Judicial Court has legal mandate to handle complaints pertaining allthe operations that are NOT nationaltabulation. If the complaint is done regarding national tabulation, theConstitutional Council handles the complaint directly, as evidently, there isnot District Judicial Court at the National Level. This effectively transformsthe Constitutional Council in the first and last instance in those cases, andonly in those cases.
