Article99: “A candidate or political party shall be deemed to have committed electoraloffence if they fail, without an acceptable excuse, to provide the Commissionwith full and thorough account of all incomes and expenditures during thecampaign, on the form prepared by the Commission, within thirty days of thedeclaration of the final results of an election or referendum.”

 

 

Article102 states that “Whoever contravenes the provisions of sections 87 to 101inclusive shall, on conviction by the competent court, be punished withimprisonment for a term not less than six months and not more than two years orwith fine to be determined by the competent court or with both.”

Comment

the Sudanese penal code was enacted in2003 and never been amended to fit the election related crimes in election law(2008). Articles 99 and 102 are the only sources about investigating electionrelated crimes and they are silent about who investigates the crimes. During2010 election, police was responsible for investigating election related crimesespecially those of stealing ballot materials.
