The South Sudan National Elections Act of 2012, Section 35a states that to organize the electoral register, the commission shall prepare the voters register at the level of the republic of the Sudan or abroad in the manner and time as prescribed by the rules. Article 35b of the Act also provides that the Commission (NEC) shall revise the electoral register by addition, deletion or amendment once per annum, or three months before any elections or referendum take place. Section 14 (2c) of the same Act mandates the Commission to prepare, revise , approve and keep the electoral register.

 

The Transitional Constitution of the Republic of South Sudan, 2011 also provide that the National Elections Commission shall be responsible for the creation, and updating of the register, in Article 195, (3a).The NEC is thus mandated to prepare the general electoral roll and pursue its annual revision. This in itself proves that the voter registration process is continuous, as the register is updated annually.
