THE CONSTITUTION OF THEREPUBLIC OF GHANA (2002)

Article 5.

(6) An issue referred fordetermination by referendum under clauses (4) and (5) shall not be taken todetermined by the referendum unless at least fifty percent of the personsentitled to vote cast their votes at the referendum, and of the votes cast atleast eighty per cent were cast in favour of that issue.

 (7) Where a referendum involves the merger oftwo or more regions, the issue shall not be taken to be determined unless atleast sixty per cent of the persons entitled to vote at the referendum in eachsuch region voted in favour of the merger of the two or more regions; andaccordingly, clause (6) of this article shall not apply to the referendum.

Article 49.

(4) Subject to the provisionsof this Constitution, an issue for determination by referendumshall not be taken to be determined unless at least thirty-five percent ofthe persons entitled to vote at the referendum voted and, of the votes cast,at least seventy percent voted in favour of the issue.

Comment

Generally 70%; however, it can be 80% or 60% (Art 5) depending on the issue.
