Ballotpapers 24.-(1)  The  Commission shall  be  responsible for preparing the ballot papers for use at a referendum.

 (2) Ballot papers shall be in Form No.5 as setout in the First Schedule to this Act and shall- (a) contain the question beingvoted on in Kiswahili language;

 (b) be  foldable,  numbered, or  a  combination of both letter and number,printed on the front;

 (c) attach a counterfoil with the same number or combination  of letter  and  number printed  on it; and

 (d) contain  a  different and  distinct  symbol for each answer to the question to be voted on.

  (3) Subject to subsection (4), the ballot papersfor voting in a referendum shall state the question or issue to be answered inform of “YES” or “NO” by the voters.

  (4) Where the question or issue to whichviews of the  people  are to  be  ascertained is  related  to  theConstitution, the Commission shall consult the Attorney General  on the  question  or issue  to  be answered  or decided.

PROVISIONSRELATING TO VALIDATION OF THE PROPOSED CONSTITUTION

Referendumquestion

37.-(1)   National Electoral  Commission  in collaboration  with the  Zanzibar  Electoral Commission shall,  within  seven days  of  the publication  of  the proposed Constitution, frame and publishin the  Gazette, the question to bedetermined by the referendum.

 (2) The question referred to in subsection (1)shall be framed after consultation with the Attorney General of the United  Republic and  the  Attorney General  of Zanzibar.

 (3) The question to be submitted to thereferendum shall  require  the voter  to  indicate whether  the  voter approves or does  not approve  the  proposed Constitution and shall be so framed as to require the voter to answer “YES”or “NO”.

 

 (4) The voting at a referendum shall be bysecret ballot.
