Kapitel 11

Folketingets godkendelse af valget

§ 88. Enhver vælger kan klage over folketingsvalg. Klager skal stiles til Folketinget og sendes til økonomi- og indenrigsministeren. Klager skal være økonomi- og indenrigsministeren i hænde senest ugedagen efter valgdagen.

“The law also mandates the Folketing to affirm the validity of general elections. The Folketing committee for elections receives and adjudicates complaints related to the elections before making a recommendation to the Folketing regarding the validity of elections. […] Rulings of the Folketing committee for elections on particular complaints, or of the Folketing regarding the validity of elections, are not subject to appeal.”

5.2. ELECTION COMPLAINTS

Any voter has the right to complain about the election. Such complaints must be sent to the Ministry of the Interior and Health (but addressed to the Folketing) within a week of the election.

The Ministry comments on the complaints before they are submitted to the Folketing for considera­tion. Complaints may concern any topic related to the conduct of the election and the counting of votes. Requests for recounts are also considered.

No court is involved in the handling of election complaints as regards the outcome or the validity of the election.

Comment

Complaints are dealt with by the parliament. However, complaints are initially sent to “økonomi- og indenrigsministeren”, which in English is the Ministry for Economic Affairs and the Interior (source: official website of the ministry athttp://english.oim.dk/). Please note that in the quote from the Guide to the Electoral System of Denmark (see sources), the name of this ministry is translated incorrectly.

This ministry comments on the complaints and then forwards them to the Folketing for consideration. There the Folketing committee for elections is responsible for adjudicating the complaints. In questions of the validity of the election, its recommendations are forwarded to the Folketing that makes the official decision
