Section 40:

“(1) The High Court shallhave jurisdiction to hear and determine any question whether:

(a) any person has been validly elected as a Representative or Senator;”

HOUSE OF ASSEMBLY (ELECTIONS) ACT 14 of 1951, CHAPTER 2:01

 

Section 65:

“A petition complaining of an undue return orundue election of a member of the House of Assembly, in this Act called anelection petition, may be presented to the High Court by any one or more of thefollowing persons:

1. some person who voted or had a right to voteat the election to which the petition relates;

2. some person claiming to have had a right tobe returned at the election;

3. some person alleging himself to have been acandidate at the election.”
