Section 44:

(3) “The petitionshall be in such form as may be prescribed by the Rules of the Supreme Courtand shall state the prescribed matter and be signed by the petitioner or allthe petitioners if more than one, and shallbe presented to the High Court.”

 

Art. 46:

“(1) An electionpetition shall be tried by the HighCourt and the judge presiding at the trial of an election petition ishereinafter referred to as the election court.”

The Eastern CaribbeanSupreme Court consists of two divisions, a Court of Appeal and a High Court ofJustice. Election petitions shall be adjudicated by the High Court at firstinstance and appeals can be lodged before the Court of Appeal.
