Article6, Wording of proposals, responses, and questions.

(1)The wording of eachproposal to be put to electors in a government initiated referendum isspecified by the Governor-General by Order in Council. The Order in Councilmust also specify the wording of each response for which electors may vote.

Article6, Proposal to promote indicative referendum petition.

(1)Every person whoproposes to promote an indicative referendum petition shall submit the proposalto the Clerk of the House of Representatives.

(2)The proposal shall beaccompanied by—

(a)a draft of theproposed indicative referendum petition; and

(b)the prescribed fee.

 

Article 9, Consultation onwording of precise question

The Clerk of the House ofRepresentatives, before making a determination under section 11,—

(a)shall consult withthe person who submitted the proposal to promote the indicative referendumpetition; and

(b)may consult with suchother persons as the Clerk of the House of Representatives thinks fit.

 

Comment

According to article 6(1) of the Referenda (Postal Voting) Act 2000, the wording for government initiated referenda is specified by the Governor-General in Council and the Order in Council (Cabinet).

For citizens initiated referenda, article 6(2) of the Citizens Initiated Referenda Act 1993 states that the person proposing a referendum must submit a draft of the proposed question. The Clerk of the House of Representatives determines the precise wording to be used, in consultation with the person who submitted the proposal, and any other person as the Clerk thinks fit.
