 INVESTIGATION OF CRIMINAL OFFENCES

  Section 157- General Provision

/1/Aprosecutor, an investigator or a policy body shall have the duty to organizetheir activities so as to effectively contribute to the timely and justifiedcriminal prosecution and to inform a promulgator to have a right to ask forreview of investigator’s or the police authority proceeding.. 

           /2/A prosecutor shall have the right to entrust aninvestigator and a police body with procedures for which they have thenecessary powers and which are necessary for the clarification of the case oridentification of the offender. An investigator shall have the same rights inrelation to a police body.

  Title Two:  Investigation

   Section 161

     Investigation Bodies

(1)Investigation shall be conducted by Police Corps investigators; summaryinvestigation shall be conducted by police authorities.

(2)Investigation shall be conducted in respect of criminal offences that are notliable to summary investigation (Section 168).

(3)Investigation shall be conducted also in respect of criminal offences that areotherwise liable to summary investigation,

a)if the defendant is in detention, serves an imprisonment sentence or is underobservation in a medical institution,

b)in the proceedings conducted against a juvenile, absconding person or persondeprived of legal capacity, person with limited legal capacity or if, in viewof physical or mental defects of the defendant, there are doubts as to hisability to put up proper defence, or

c)if so ordered by a prosecutor.

           (4) Investigation shall be conducted also in respect ofconcurrent criminal offences where investigation is to be opened in least oneof these offences.

           (5) Where a reference to investigation is made in this Act,it shall also mean summary investigation, unless the nature of the case impliesotherwise.'.
