159. Such Magistrate, on receiving such report, maydirect an
investigation or, if he thinks fit, at once proceed,or depute any
Magistrate subordinate to him to proceed, to hold apreliminary
inquiry into, or otherwise to dispose of, the case inmanner
provided in this Code.
(a) the Magistrate empowered to take cognizance ofsuch offence
or making the order for investigation may, if theoffence to which
the investigation relates is not punishable withdeath
imprisonment for life or imprisonment exceeding tenyears,
release the accused on bail to the satisfaction ofsuch Magistrate;
and
“No police-officer shall investigate a non-cognizablecase
without the order of aMagistrate”
“(3) Any Magistrate empowered under section 190 mayorder such
and investigation as above mentioned.”
