384 Prosecution of offences
(1) Subject to subsection(2), an offence against subsection 315(3) or
section 326 is anindictable offence.
(2) A court of summaryjurisdiction may hear and determine
proceedings in respect ofan offence referred to in subsection (1) if
the court is satisfied thatit is proper to do so and the defendant and
the prosecutor consent.
