32(1) There shall be an Electoral Commission for Sierra Leone.

32(2) The members of the Electoral Commission shall be a Chief Electoral Commissioner, who shall be Chairman, and four other members who shall be known as Electoral Commissioners.

Article 32.(7) Subject to the provisions of this section, a member of the Electoral Commission shall vacate his office:

32(3) The members of the Electoral Commission shall be appointed by the President after consultation with the leaders of all registered political parties and subject to the approval of Parliament.

There is no clear indication in the law regarding the appointment or election of the Chairman. Therefore, we based our decision on Article 32 of the Constitution.
The Public Elections Act (2012)
(2) The Chairman and other members of the Commission shall subject to section 33 ofthe Constitution, be persons of proven integrity.
