Questionsas to elected members to be determined by High Court

 

82 (1) All questions which may arise from any election as to theright of any person to be or remain an elected member of the NationalParliament shall be referred to and determined by the Court on a petitionpresented by the Attorney-General or by an

elector, in accordance with the procedure prescribed by Rules madeunder section 85 for the presentation and hearing of an election petition andthe decision of the Court on any such petition shall be final and shall not bequestioned in any other proceedings.

 

(2) Where the question to be decided concerns the right of anyperson to remain a member of the National Parliament, the Court shall certifyits decision in writing to the Governor-General and where the Court has decidedthat any person is not entitled

to remain a member, such person shall thereupon cease to be amember.
