12 § Val till riksdagen får överklagas hos en av riksdagen utsedd valprövningsnämnd. [...]
Valprövningsnämnden består av en ordförande, som ska vara eller ha varit ordinarie domare och som inte får tillhöra riksdagen, och sex andra ledamöter. Ledamöterna väljs efter varje ordinarie val, så snart valet har vunnit laga kraft, för tiden till dess nytt val till nämnden har ägt rum. Ordföranden väljs särskilt. Lag (2010:1408).
The Election Review Board (Valprövningsnämnden) is a committee chosen by the legislative assembly (Riksdag). Its six members are chosen from among the members of the legislative assembly. The president of the Election Review Board cannot be a member of parliament and is required to be or to have been a judge. This body is clearly not a court, nor is it strictly speaking a specialised administrative body.
Response by Helena Brogren, Senior Administrative Officer at the Swedish Election Authority (EMB) confirmed that the Election Authority receives complaints and hands it over to the Elections Review Board, which is the first and the last instance.
