Article.77 An appeal may be filed with the cantonal government:

(1) a. in respect of a violation of the provisions on votingrights in terms of Articles 2-4, Article 5 paragraphs 3 and 6 and Articles 62and 63 (appeal on a matter related to voting rights);

b.in respect of irregularities at popular votes (appeal on amatter related to popular votes);

c.in respect of irregularities in the preparation for and conduct ofelections to the National Council (appeal on a matter related toelections).

(2) The appeal must be filed by registered mail within three days of thegrounds for appeal being ascertained, and at the latest on the third dayfollowing publication of the results in the official cantonal gazette.

For elections to theNational Council, the dispute resolution mechanism is regulated by the FederalAct on Political Rights. In the first instance, any complaints must be lodgedwithin three days with the cantonal government. The cantonal authorities mustissue a decision within ten days and order appropriate remedies if there havebeen irregularities. Cantonal authorities may reject an appeal withoutconducting an investigation if they consider that the nature or the extent of thealleged irregularities do not have the potential to have an impact on theresult of the elections as a whole. Cantonal governments are obliged to notifythe Federal Chancellery of any complaints. In line with the FederalConstitution, appeals of cantonal decisions may be filed with the FederalSupreme Court within three days of the cantonal decision. There is no legaldeadline for the Federal Supreme Court to issue a decision. The deadline forfiling a complaint about election results expires three days after the resultshave been published in the official gazette of a canton.
