Part 1, President to directthe conduct of a Referendum, Section 2.
(1) A Referendum in terms ofChapter XIII of me Constitution shall be conducted by the Commissioner ofElections (hereinafter referred to as the Commissioner), where the Presidenthas, by Proclamation published in the Gazette, directed such Commissioner toconduct a Referendum.
(2) A Proclamation issuedunder subsection (1) shall:
(a)specify the proposal to beput to the People at the Referendum in the form of a question which shall beanswered by a ' Yes ' or a ' No ' and
(b)appoint a day for thetaking of the poll at such Referendum. Such day shall be
(i) a day not earlier thanthirty days from the date of publication of the Proclamation
(ii)a day other than a FullMoon Poya day or any public holiday specified in the First Schedule to theHolidays Act, No. 29 of 1971 and if, after the publication of the Proclamation,the day specified in such Proclamation is declared to be a public holiday, suchdeclaration shall in no way affect the validity of anything done on such dayfor the purpose of holding the Referendum.
