Article 136 (1) and (2).

1. Citizens who have beenregistered as voters within the national territory, and those living abroad whohave been properly registered as voters, may be called to take part inreferenda on major national issues.

 

(Constitutional Amendements)

Article 136

 

The following matters may not be the subject ofreferenda:

 

3a. Amendmentsto the Constitution, with the exception of those in article 292 (1), […]

 

Article 292.(exception)

 

Constitutional amendment laws shallhave to respect the following:

 

a) the independence, the sovereigntyand the unity of the State;

 

b) the republican form ofGovernment;

 

c) the separation between religiousdenominations and the State;

 

d) the fundamental rights, freedomsand guarantees;

 

e) universal, direct, secret,personal, equal and periodic suffrage for the appointment of elective sovereignpublic offices and elective offices of local administration;

 

f) pluralism of expression and ofpolitical organisation, including political parties and the right of democraticopposition;

 

g) the separation andinterdependence of the sovereign public offices;

 

h) the scrutiny ofconstitutionality;

 

i) the independence of thejudiciary;

 

j) the autonomy of localauthorities;

 

k) the rights of workers and tradeunions;

 

l) the rules governing nationality,which cannot be amended in such a way as to restrict or remove rights ofcitizenship.
