Article 135

1. Theprovisions of Chapters 1, 2 and 9 of the Constitution of the Russian Federationmay not be revised by the Federal Assembly.

2. If a proposalon revising the provisions of Chapters 1, 2 and 9 of the Constitution of theRussian Federation is supported by three fifths of the total number of membersof the Council of Federation and deputies of the State Duma, then in accordancewith federal constitutional law, a Constitutional Assembly shall be convened.

3. TheConstitutional Assembly shall either confirm the invariability of theConstitution of the Russian Federation or draft a new Constitution of theRussian Federation, which shall be adopted by the Constitutional Assembly bytwo thirds of the total number of its members or shall be referred to areferendum. In the event that a referendum is held, the Constitution of theRussian Federation shall be considered to have been adopted if over one half ofvoters who participated in the vote voted in favour of it and provided thatover a half of the electorate participated in the referendum.

Article 70.8. A referendum shall bedeclared not to have taken place by the relevant referendum commission if notmore than half of the referendum participants included in referendumparticipant lists took part in it on the territory where the referendum isconducted. The relevant referendum commission shall declare that a decision hasnot been adopted at a referendum if not more than half of the referendumparticipants who took part in voting at the referendum voted for this decision.No other grounds for declaring a referendum not to have taken place shall beestablished by the law of a subject of the Russian Federation.
