39. Are there limits on the amount a political party can spend?

Art. 26(3) of The Law on Political Parties (294/2007, amended in 2025):

“(3) The annual income of a political party from membership fees and donations may not exceed the equivalent of 0.1% of the income provided for in the state budget for the respective year.”

Art. 53(1) and Art. 53(11) of The Electoral Code (325/2022, amended in 2025):

“(1) The general national ceiling for financial resources that may be transferred to the account marked "Election Fund"/"Intended for the initiative group" shall be 0.1% of the revenues provided for in the state budget law for the respective year.

(11) The ceiling provided for in paragraph (1) also includes donations in the form of property, goods, merchandise, objects, as well as works or services provided free of charge or under conditions more advantageous than the commercial or market value.”

NOTE: The state budget for 2025 is equivalent to 71553900,0 thousand MDL.

“(3) Veniturile anuale ale unui partid politic provenite din cotizaţii de membru şi donaţii nu pot depăşi echivalentul a 0,1% din veniturile prevăzute în bugetul de stat pentru anul respectiv.”

Art. 53(1) și Art. 53(11) din Codul Electoral al Republicii Moldova (2022, modificat în 2025):

“(1) Plafonul general la nivel național al mijloacelor financiare ce pot fi transferate în contul cu mențiunea „Fond electoral”/„Destinat grupului de inițiativă” constituie 0,1% din veniturile prevăzute în legea bugetului de stat pentru anul respectiv.

(11) În limita plafonului prevăzut la alin. (1) se includ și donațiile sub formă de proprietăți, bunuri, mărfuri, obiecte, precum și lucrările ori serviciile prestate în mod gratuit sau în condiții mai avantajoase decât valoarea comercială sau de piață.”
