36. Is the provision of direct public funding to political parties tied to gender equality among candidates?

Art. 28(21) of The Law on Political Parties (294/2007, amended in 2025):

“(21) 20% of the value of annual allocations from the state budget shall be used for the purpose of promoting and encouraging women's participation in political and electoral processes, and 10% of promoting and encouraging women's participation in political and electoral processes, and 10% of the value of the allocations received shall be used to promote and encourage young people in political and electoral processes. In the case of political parties with women's and youth organizations, these funds shall be managed by the organizations concerned.”

Art. 27(1) of The Law on Political Parties (294/2007, amended in 2025):

“(1) Political parties shall be entitled to receive annual funding from the state budget through the Central Electoral Commission. The regulations on the financing of political parties, including the calculation methodology, shall be approved by the Central Electoral Commission.

The amount of allocations for this purpose shall be approved in the annual budget law, the percentage being 0.1% of the state budget revenues, except for the revenues with special purpose provided by law, and shall be distributed as follows:

a) 30% – to political parties in proportion to their performance in parliamentary elections;
b) 30% – to political parties in proportion to their performance in general local elections;
c) 15% – to political parties in proportion to their performance in presidential elections;
d) 7.5% – to political parties in proportion to the number of women actually elected in parliamentary elections;
e) 7.5% – to political parties in proportion to the number of women actually elected in local elections;
f) 5% – to political parties in proportion to the number of young people actually elected in parliamentary elections;
g) 5% – to political parties in proportion to the number of young people actually elected in local elections.”

“(21) 20% din valoarea alocațiilor anuale de la bugetul de stat vor fi utilizate în scopul promovării și încurajării participării femeilor în procesele politic și electoral, iar 10% din valoarea alocațiilor primite vor fi utilizate pentru promovarea și încurajarea tinerilor în procesele politic și electoral. În cazul partidelor politice în care există organizații ale femeilor și ale tinerilor, aceste fonduri vor fi gestionate de organizațiile în cauză.”

Art. 27(1) din Legea privind partidele politice (294/2007, modificată în 2025):

“(1) Partidele politice au dreptul să primească anual finanţare de la bugetul de stat prin intermediul Comisiei Electorale Centrale. Regulamentul privind finanțarea partidelor politice, inclusiv metodologia de calcul, este aprobat de către Comisia Electorală Centrală. Cuantumul alocaţiilor pentru acest scop se aprobă în legea bugetară anuală, cota procentuală constituind 0,1% din veniturile bugetului de stat, cu excepţia veniturilor cu destinaţie specială prevăzute de legislaţie, şi se distribuie după cum urmează:

a) 30% – partidelor politice proporțional cu performanțele obținute în alegerile parlamentare;
b) 30% – partidelor politice proporțional cu performanțele obținute în alegerile locale generale;
c) 15% – partidelor politice proporțional cu performanțele obținute în alegerile prezidențiale;
d) 7,5% – partidelor politice proporțional cu femeile alese efectiv în cadrul alegerilor parlamentare;
e) 7,5% – partidelor politice proporțional cu femeile alese efectiv în cadrul alegerilor locale;
f) 5% – partidelor politice proporțional cu tinerii aleși efectiv în cadrul alegerilor parlamentare;
g) 5% – partidelor politice proporțional cu tinerii aleși efectiv în cadrul alegerilor locale.”
