18. Is there a limit on the amount a donor can contribute to a candidate?

Art. 57(4) of The Electoral Code (325/2022, amended in 2025):

(RO)

“(4) Contribuțiile sub formă de donații pot fi făcute de persoane fizice și juridice, cu respectarea restricțiilor stabilite la art. 54 alin. (5), după cum urmează:

1) persoanele fizice cetăţeni ai Republicii Moldova, inclusiv întreprinzătorii individuali, gospodăriile țărănești, deținătorii de patente, agenții cu statut independent, precum și cei care desfășoară activități independente sau prestează servicii profesionale în sensul art. 5 pct. 35)–36³) din Codul fiscal nr. 1163/1997:

a) au dreptul să doneze în perioada activității grupurilor de inițiativă și în timpul campaniilor electorale până la 6 salarii medii lunare pe economie stabilite pentru anul respectiv, dar nu mai mult de 30% din venitul anual al acestora înregistrat pentru anul calendaristic precedent;

b) în cazul în care dețin statut de persoane cu funcții de demnitate publică, de funcționari publici, inclusiv cu statut special, sau de angajați în organizații publice în sensul Legii nr. 133/2016 privind declararea averii și a intereselor personale, pot face donații al căror plafon să nu depășească 10% din venitul lor anual, dar nu mai mult de 6 salarii medii lunare pe economie stabilite pe anul respectiv;

c) în cazul în care donatorul beneficiază doar de burse sau alte prestații sociale, plafonul donației nu poate să depășească un salariu mediu lunar pe economie pentru anul respectiv și nu poate să depășească 30% din cuantumul anual al burselor sau altor prestații sociale de care a beneficiat în anul calendaristic precedent; [...]

2) persoanele juridice:

a) pot face donații în contul cu mențiunea „Fond electoral” și „Destinat grupului de inițiativă” cumulativ până la 12 salarii medii lunare pe economie stabilite pentru anul respectiv, dar nu mai mult de 30% din venitul anual al persoanei juridice respective înregistrat pentru anul calendaristic precedent;

b) pot face donații de mijloace bănești în contul cu mențiunea „Fond electoral”/„Destinat grupului de inițiativă” numai prin transfer, împreună cu o declarație pe propria răspundere privind lipsa restricțiilor prevăzute la art. 54 alin. (5) lit. d), f) și g);

c) prezintă spre păstrare entităților prevăzute la alin. (2) informația eliberată de la Serviciul Fiscal de Stat despre lipsa restanțelor față de buget.”

“ (4) Contributions in the form of donations may be made by natural and legal persons, subject to
the restrictions set out in Article 54(5), as follows:

1) natural persons who are citizens of the Republic of Moldova, including individual entrepreneurs,
peasant households, patent holders, independent agents, as well as those who carry out independent activities or provide professional services within the meaning of Article 5(35)-(363) of the Tax Code No. 1163/1997:

a) have the right to donate during the period of activity of initiative groups and during election campaigns up to 6 average monthly salaries for the economy established for the respective year, but not more than 30% of their annual income recorded for the previous calendar year;

b) if they hold the status of public persons, civil servants, including those with special status, or employees in public organizations within the meaning of Law No. 133/2016 on the declaration of assets and personal interests, they may make donations whose ceiling does not exceed 10% of their annual income, but not more than 6 average monthly salaries in the economy established for that year;

c) if the donor only receives scholarships or other social benefits, the donation ceiling may not exceed one average monthly salary for the economy for the year in question and may not exceed 30% of the annual amount of scholarships or other social benefits received during the calendar year. [...]

2) Legal entities:

a) may make donations to the account marked "Election Fund" and "Intended for the initiative group"
up to a cumulative total of 12 average monthly salaries in the economy established for the
respective year, but not more than 30% of the annual income of the respective legal entity
registered for the previous calendar year;

b) may make donations of funds to the account marked "Election Fund"/"Intended for the initiative group" only by transfer, together with a statement on their own responsibility regarding the absence of the restrictions provided for in Art. 54 para. (5) letters d), f) and g);

c) submit for safekeeping to the entities referred to in para. (2) the information issued by the
State Tax Service regarding the absence of arrears to the budget.”

There is a limit for both natural and legal persons. For natural persons: 6 average monthly salaries per economy for that year;

For legal persons:12 average monthly salaries in the economy established for that year.

NOTE: The average monthly salary set for the year of 2025 is 16100 MDL.
