10. Is there a ban on donations from corporations with government contracts to candidates?

Art. 54(5) of The Electoral Code (325/2022, amended in 2025):

(RO)

“(5) Se interzice finanțarea ori susținerea materială sub orice formă a grupurilor de inițiativă, a campaniilor electorale de către:

d) persoanele juridice care, în ultimii trei ani înainte de începerea perioadei electorale, au încheiat contracte de achiziții publice de lucrări, bunuri sau servicii în sensul Legii nr. 131/2015 privind achizițiile publice sau care au beneficiat de ajutoare de stat în sensul Legii nr. 139/2012 cu privire la ajutorul de stat, precum și de către persoanele juridice care, la data efectuării donației, au restanțe la bugetul de stat, bugetul asigurărilor sociale de stat sau la fondurile asigurării obligatorii de asistență medicală;”

“ (5): It is prohibited to finance or materially support in any form initiative groups or election campaigns by: [...]

d) legal entities which, in the last three years prior to the start of the election period, have concluded public procurement contracts for works, goods, or services within the meaning of Law No. 131/2015 on public procurement or which have benefited from state aid within the the meaning of Law No. 139/2012 on state aid, as well as by legal persons who, at the time of making the donation, have arrears to the state budget, the state social insurance budget or the compulsory health insurance funds”

The law states clearly that any actor/ corporation that has contracts with the government cannot donate to candidates.
