(BS)

(1) Finansiranje političkih stranaka zabranjuje se:  
a) organima uprave države Bosne i Hercegovine, entiteta, kantona, Brčko Distrikta Bosne i Hercegovine, te gradskim i općinskim organima,  b) javnim institucijama,  c) javnim preduzećima,  d) humanitarnim organizacijama,  e) neimenovanim, odnosno anonimnim donatorima,  f) vjerskim zajednicama,  g) sindikatima, udruženjima i drugim neprofitnim organizacijama koje se finansiraju javnim sredstvima bez obzira na iznos sredstava,  h) pravnim licima u kojima uloženi javni kapital iznosi najmanje 25%,  i) drugim državama, stranim političkim strankama i stranim pravnim licima. (2) Zabrana iz stava (1) tačke a) ovog člana ne odnosi se na korištenje poslovnih prostorija, koje političke stranke koriste na osnovu odluke nadležnog organa.  
(3) Izuzetno, zabrana finansiranja političkih stranaka iz stava (1) tačke i) ovog člana ne odnosi se na finansiranje programa namijenjenih za edukaciju, a s ciljem razvoja i promoviranja demokratskih principa.  (4) Privatna preduzeća koja su s organima izvršne vlasti na svim nivoima u Bosni i  Hercegovini sklopila ugovor o javnoj nabavci usluga, ugovor o javnoj nabavci robe ili ugovor o javnoj nabavci radova, u skladu s propisima o javnim nabavkama u Bosni i Hercegovini, ne mogu finansijski pomagati političke stranke ako vrijednost ugovora u jednoj kalendarskoj godini prelazi iznos od 10.000,00 KM (deset hiljada konvertibilnih maraka).   (5) Političke stranke ne mogu ostvarivati prihode od imovine koja nije u njihovom vlasništvu. (6) Zabranjeno je davanje dobrovoljnih priloga u novcu ili u formi proizvoda posredstvom trećih lica (posrednika). (7) Eventualni dobrovoljni prilozi uplaćeni na račun političke stranke iz nedopuštenih izvora prema st. (1) i (6) ovog člana, kao i iznosi dobrovoljnih priloga koji prelaze iznose utvrđene u članu 6. ovog zakona, te eventualne uplate dobrovoljnih priloga od neimenovanih, odnosno anonimnih izvora, politička stranka dužna je uplatiti u korist budžeta BiH, najkasnije u roku osam dana od dana primljene uplate, te o tome obavijestiti Centralnu izbornu komisiju Bosne i Hercegovine.  

Odredbe ovog zakona koje se odnose na dobrovoljne priloge, zabranu finansiranja i pogodovanja te nadzor i finansijsko poslovanje odgovarajuće se primjenjuju na liste nezavisnih kandidata i nezavisne kandidate.

(1) The financing of political parties is prohibited from: a) administrative bodies of the state of Bosnia and Herzegovina, the entities, cantons, the Brčko District of Bosnia and Herzegovina, as well as city and municipal bodies, b) public institutions, c) public enterprises, d) humanitarian organizations, e) unnamed or anonymous donors, f) religious communities, g) trade unions, associations, and other non-profit organizations financed from public funds, regardless of the amount of such funds, h) legal entities in which invested public capital amounts to at least 25%, i) other states, foreign political parties, and foreign legal entities.
(2) The prohibition under paragraph (1), item a) of this Article does not apply to the use of business premises used by political parties on the basis of a decision of the competent authority. (3) By way of exception, the prohibition of financing of political parties under paragraph (1), item i) of this Article does not apply to the financing of programs intended for education, with the aim of developing and promoting democratic principles. (4) Private companies that have concluded a public procurement contract for services, goods, or works with executive authorities at any level in Bosnia and Herzegovina, in accordance with public procurement regulations in Bosnia and Herzegovina, may not provide financial support to political parties if the value of the contract in a single calendar year exceeds 10,000 KM (ten thousand convertible marks). (5) Political parties may not generate income from property that is not owned by them. (6) It is prohibited to make voluntary contributions in money or in the form of goods through third parties (intermediaries). (7) Any voluntary contributions paid into the account of a political party from prohibited sources under paragraphs (1) and (6) of this Article, as well as voluntary contributions exceeding the amounts established in Article 6 of this Law, and any voluntary contributions from unnamed or anonymous sources, must be transferred by the political party to the budget of Bosnia and Herzegovina no later than eight days from the date of receipt, and the Central Election Commission of Bosnia and Herzegovina must be notified thereof.

The provisions of this Law referring to contributions, prohibition of financing and favoring, and monitoring and financial transactions shall be appropriately applied to lists of independent candidates and independent candidates.
