52. Must reports from political parties and/or candidates reveal the identity of donors?

Стаття 14, Закон "Про політичні партії в Україні" (2001):
Якщо грошовий внесок здійснюється фізичною особою, то обраний нею спосіб здійснення банківської операції повинен забезпечувати можливість ідентифікації цієї фізичної особи.
Документ, сформований за результатами такої банківської операції, повинен містити інформацію про прізвище, ім’я та (за наявності) по батькові, місце проживання, реєстраційний номер облікової картки платника податків або ідентифікаційний номер згідно з Державним реєстром фізичних осіб - платників податків та інших обов’язкових платежів (щодо осіб, які через свої релігійні переконання відмовилися від прийняття реєстраційного номера облікової картки платника податків та повідомили про це відповідний контролюючий орган і мають відмітку в паспорті, - номер та (за наявності) серію паспорта громадянина України, в якому проставлено відмітку про відмову від одержання ідентифікаційного номера чи номера паспорта із записом про відмову від прийняття реєстраційного номера облікової картки платника податків в електронному безконтактному носії), дату народження, призначення платежу.

Стаття 17, Закон "Про політичні партії в Україні" (2001):
Зазначені у звітах відомості про реєстраційний номер облікової картки платника податків або серію та номер паспорта громадянина України, місце проживання фізичної особи (крім назви адміністративно-територіальної одиниці, зазначеної у частині другій статті 133 Конституції України), дату народження є інформацією з обмеженим доступом та не підлягають відображенню у відкритому доступі.

Стаття 153, Виборчий кодекс України (2020):
7. У фінансових звітах, передбачених частинами п’ятою і шостою цієї статті, обов’язковому оприлюдненню підлягають прізвище, ім’я, по батькові та місце проживання фізичної особи (область, район, населений пункт). Інші відомості про фізичну особу, віднесені до інформації з обмеженим доступом, оприлюдненню не підлягають.
10. У фінансових звітах, передбачених частинами четвертою, п’ятою та шостою цієї статті, в обов’язковому порядку відображається інформація про всі надходження на накопичувальний та поточні рахунки виборчого фонду партії, поточний рахунок власного виборчого фонду кандидата, здійснені витрати та залишки коштів на відповідних рахунках, у тому числі інформація про дату надходження кожного внеску до відповідного виборчого фонду, його розмір, особу, яка здійснила внесок на відповідний рахунок виборчого фонду, назву партії, призначення, дату здійснення і суму кожного платежу з відповідного рахунку виборчого фонду, отримувача кожного платежу.

Article 14, Law "On Political Parties in Ukraine" (2001):
If a monetary donation is made by an individual, then the method for performing the banking transaction chosen by the individual must provide for the possibility to identify that individual.
The document formed as a result of such banking transaction must contain information on the last name, first name and patronymic (if any), place of residence, registration number of tax payer’s record card or identification number according to the State Register of Individual Payers of Taxes and Other Mandatory Payments (in respect of persons who based on their religious beliefs refused to accept the registration number of tax payer’s record card and reported this to the respective supervisory authority and have a mark in the passport – the number and series (if any) of the passport of citizen of Ukraine in which a mark has been placed on refusal to accept an identification number or the number of passport with an entry on refusal to accept the registration number of tax payer’s record card on an electronic contactless data carrier), the date of birth, and the purpose of the payment.

Article 17, Law "On Political Parties in Ukraine" (2001):
Information on the registration number of tax payer’s record care or series and number of passport of citizen of Ukraine, place of residence of an individual (except the name of the administrative territorial unit specified in Part two, Article 133 of the Constitution of Ukraine), and date of birth which is provided in the reports shall be considered limited access information and shall not be subject to open access.

Article 153, Electoral Code of Ukraine (2020):
7. The financial reports envisaged by parts 5 and 6 of this Article shall always disclose data on last name, given name, patronymic and place of residence of an individual (oblast, raion, locality). No other information on an individual, classified as information with limited access, shall be made public.
10. Financial reports required by parts 4, 5 and 6 of this Article shall contain information detailing all sums received into the accumulation and current accounts of the election fund of the party, the current account of the candidate's own election fund, all expenses incurred and balances on respective accounts, including information on the date of each contribution being received into the election fund, its amount, the person who contributed to the respective account of the election fund, name of the party, purpose, date and amount of each payment from the respective account of the election fund, and the recipient of each payment.

Reports from political parties and candidates must contain all the information necessary to identify donors. At the same time, most of this information is not subject to disclosure (except for the surname, first name, patronymic, and place of residence in the format specified by law).
