– Artikel 5 Absatz 3 GG (Kunstfreiheit) und
– Artikel 21 GG (Parteienprivileg).

Election advertising
Election advertising is not regulated by law.
However, the fundamental possibility of election advertising is protected by
– Article 5(1) of the Basic Law (GG) (freedom of the press),
– Article 5(3) GG (freedom of art), and
– Article 21 GG (privilege of political parties).

Access to airtime for election advertising
Television and radio broadcasters must provide participating parties with appropriate airtime for election advertising, proportional to the party’s significance.
This airtime is provided against reimbursement of production costs (self-costs), not free of charge.
