29. What are the eligibility criteria for political parties to receive public funding?

ALB: 1. Çdo vit në Buxhetin e Shtetit përcaktohet një fond që shërben si ndihmë financiare publike për kryerjen e veprimtarisë vjetore të partive politike. Ndihma financiare e parashikuar në Buxhetin e Shtetit në vitet jozgjedhore, si rregull, nuk mund të jetë më e vogël se ndihma e parashikuar në vitin paraardhës.
2. Ky fond ndahet sipas rregullave të mëposhtme:
a) 70 për qind, sipas numrit të deputetëve të fituar në zgjedhjet e fundit parlamentare. Çdo parti parlamentare përfiton ndihmë financiare në përputhje me numrin e deputetëve që ka fituar në bazë të sistemit zgjedhor të parashikuar në Kodin Zgjedhor;
b) 20 për qind, në mënyrë të barabartë, ndërmjet partive parlamentare dhe partive që kanë marrë mbi 10 mijë vota në zgjedhjet e fundit parlamentare.
c) 10 për qind, sipas përqindjes së fituar ndërmjet partive politike që kanë marrë pjesë në zgjedhjet e fundit parlamentare dhe kanë fituar mbi 1 për qind të votave në shkallë vendi.
Pjesa që mbetet pa u shpërndarë nga 10-përqindëshi i shtohet fondit prej 70 për qind dhe u ndahet partive parlamentare.

1. A fund which shall serve as public financial aid for the annual activities of political parties shall be allocated each year in the State Budget. The financial aid foreseen in the state budget during non-electoral years, as a rule, shall not be less than the aid foreseen in the preceding year.
2. The fund shall be divided according to the following rules:
a) 70 percent shall be divided according to the number of seats obtained in the last parliamentary elections. Each party sitting in parliament shall be entitled to financial aid in accordance with the number of seats obtained based on the proportional system;
b) 20 percent shall be divided equally among parliamentary parties and the parties which have received more than 10 thousand votes in the last parliamentary elections;
c) 10 percent shall be divided according to the percentage obtained among [by] the political parties that took part in the last parliamentary elections and obtained over 1 percent of the votes.
The non-allocated remainder of the 10 percent shall be added to the 70 percent fund and it shall be divided among parliamentary parties.

ALB: Fondet nga Buxheti i Shtetit për financimin e partive pjesëmarrëse në zgjedhje
1. Partitë politike pjesëmarrëse në zgjedhje dhe që kanë marrë jo më pak se 1 për qind të votave në shkallë vendi në zgjedhjet më të afërta pararendëse të të njëjtit lloj, përfitojnë fonde nga Buxheti i Shtetit, në bazë të numrit të votave që secila parti ka marrë në ato zgjedhje. Fondi për këtë qëllim përcaktohet me vendim të Kuvendit dhe përbën zë më vete në Buxhetin e Shtetit për vitin zgjedhor përkatës. Ky fond nuk mund të jetë më pak sesa totali i shumave të shpërndara partive politike në zgjedhjet pararendëse.
2. KQZ-ja, brenda 10 ditëve nga nxjerrja e rezultatit përfundimtar në shkallë vendi, përcakton me vendim vlerën në para të një vote të vlefshme, duke pjesëtuar fondin e përgjithshëm të miratuar, me numrin e përgjithshëm të votave të vlefshme të grumbulluara nga partitë politike pjesëmarrëse në zgjedhje, që kanë marrë jo më pak se 1 për qind të votave të vlefshme në shkallë vendi. Për zgjedhjet e organeve të qeverisjes vendore llogaritja bëhet mbi bazën e votave të marra për këshillat vendorë në shkallë vendi.
3. KQZ-ja përllogarit shumën që i takon secilës parti, duke shumëzuar vlerën në para të një vote të vlefshme, të përcaktuar sipas pikës 2 të këtij neni, me numrin e votave të vlefshme që ka marrë secila parti në zgjedhjet pararendëse të të njëjtit lloj. Për partitë pjesëtare në koalicion, numri i votave të vlefshme takuese përllogaritet duke mbledhur mesataren e votave për mandat për çdo kandidat të zgjedhur nga radhët e tyre.
4. KQZ-ja zbret nga shuma e përllogaritur, sipas pikës 3, sanksionet financiare që janë bërë titull ekzekutiv, të vëna për partinë përkatëse, sipas këtij ligji.

ENG: State budget funds to finance parties running in elections 
1. Political parties participating in elections, which obtained not less than 1% of votes at a national level in the last elections of the same type, shall benefit State budget funds based on the number of votes that each party received in those elections. Funds for this purpose shall be defined in an Assembly decision and comprise a separate budget item in the State Budget of the corresponding electoral year. This fund may not be less than the total amounts distributed to political parties in the previous elections.
2. Within 10 days from the announcement of the final result at a national level, the CEC shall determine, by decision, the monetary value of a valid vote, by dividing the total funds approved with the total valid votes received by the political parties participating in the elections, which have received no less than 1% of valid votes at a national level. For elections for local government bodies, the calculation shall be based on votes received for local councils at a national level.
3. The CEC shall calculate the amount that belongs to each party, by multiplying the monetary value of a valid vote, as provided for in point 2 of this Article, to the number of valid votes received by each party in the previous elections of the same type. For parties participating in a coalition, the number of respective valid votes shall be calculated by adding up the average of votes per mandate for each candidate elected from their ranks.

According to the Law on Political Parties (Art. 19) and the Electoral Code (Art. 88), political parties must meet specific conditions to receive public funding, for example, obtaining at least 1% of valid votes nationwide in the most recent elections. Public funds are then allocated based on objective criteria such as the number of parliamentary seats won, total votes received, or equal distribution among qualifying parties.
