54. Must reports from political parties and/or candidates include information on itemized spending?

Article 38.1-2, ustawa o partiach politycznych 1997 (Law on Political Parties 1997, consolidated text 2023)
Art. 38 1. Partia polityczna składa Państwowej Komisji Wyborczej, nie później niż do 31 marca każdego roku, sprawozdanie o źródłach pozyskania środków finansowych, w tym o kredytach bankowych i warunkach ich uzyskania oraz o wydatkach poniesionych ze środków Funduszu Wyborczego w poprzednim roku kalendarzowym, zwane dalej „sprawozdaniem”. 
2. Minister właściwy do spraw finansów publicznych, po zasięgnięciu opinii Państwowej Komisji Wyborczej, określa, w drodze rozporządzenia: 
1) wzór sprawozdania, w tym również w wersji elektronicznej, 
2) zakres danych zawartych w sprawozdaniu i sposób ich prezentacji, 
3) sposób sporządzenia sprawozdania, w tym wykazów, o których mowa w tym sprawozdaniu,                           4) sposób składania sprawozdania, w tym również drogą elektroniczną, 
5) wykaz dokumentów, które należy dołączyć do sprawozdania (…). 
English translation:
“Art. 38.1. A political party submits to the National Election Commission, no later than March 31 of each year, a report on the sources of obtaining funds, including bank loans and the conditions for obtaining them, and on expenses incurred from the Election Fund in the previous calendar year, hereinafter referred to as “report”.
2. The minister responsible for public finances, after consulting the National Election Commission, specifies by ordinance: 
1) report template, including in electronic format, 
2) the scope of data in the report and the method of its presentation,
3) the manner of preparing the report, including the lists referred to in this report,
4) method of submitting the report, including electronically,
5) list of documents that should be attached to the report (…).”

Art. 34.1. Partie polityczne sporządzają coroczną informację finansową o otrzymanej subwencji oraz o poniesionych z subwencji wydatkach, zwaną dalej „informacją”. 
2. Partie polityczne składają informację za rok kalendarzowy Państwowej Komisji Wyborczej w terminie do 31 marca następnego roku. 
3. Minister właściwy do spraw finansów publicznych, po zasięgnięciu opinii Państwowej Komisji Wyborczej, określa, w drodze rozporządzenia: 
1) wzór informacji, w tym również w wersji elektronicznej, 
2) zakres danych zawartych w informacji i sposób ich prezentacji (…).

“Art. 34.1. Political parties prepare annual financial information on the received subvention and the expenses incurred from this subvention, hereinafter referred to as “information”. 
2. Political parties submit information for the calendar year to the National Election Commission by 31 March of the following year.

Article 84 § 1, Kodeks wyborczy 2011 (Election Code 2011, consolidated text 2025)
Art. 84 § 1. Prawo zgłaszania kandydatów w wyborach przysługuje komitetom wyborczym. Komitety wyborcze wykonują również inne czynności wyborcze, a w szczególności prowadzą na zasadzie wyłączności kampanię wyborczą na rzecz kandydatów.

Punkt 2. (…) Oznacza to, że wszelkie czynności związane z pozyskiwaniem środków finansowych, dokonywaniem wydatków na organizowanie spotkań wyborczych i promocją kandydatów w formie plakatów, ulotek, itd., mogą być prowadzone tylko przez komitety wyborcze i wyłącznie w okresie kampanii wyborczej (…).
English translation:
“Point 2. (…) This means that all activities related to raising funds, making expenditures for organizing election meetings and promoting individual candidates in the form of posters, leaflets, etc., can only be conducted by election committees and only during the election campaign (…).”

Minister właściwy do spraw finansów publicznych, po zasięgnięciu opinii Państwowej Komisji Wyborczej, określi, w drodze rozporządzenia, wzór sprawozdania finansowego, wykaz rodzajów dokumentów, jakie należy załączyć do sprawozdania finansowego, sposób przekazania, w tym również w formie elektronicznej, organom wyborczym tego sprawozdania oraz dokumentów do niego załączonych, w szczególności: (…).

“Art. 142 § 1. The financial representative within 3 months from the election day, submit to the electoral body to which the election committee submitted a notification of its establishment, a report on the committee’s revenues, expenditures and financial liabilities, including bank loans obtained and the conditions for obtaining them, hereinafter referred to as the “financial report”.
§ 7. The minister responsible for public finances, after obtaining an opinion of the National Election Commission, specify, by regulation, the template of the financial report, the list of types of documents that should be attached to the financial report, and the method of submitting, also including in electronic form, this report and the documents attached to it to electoral authorities, in particular: (…).”

Dokumenty, jakie należy załączyć do sprawozdania finansowego o przychodach, wydatkach i zobowiązaniach finansowych komitetu wyborczego: (…)
3) dokumenty umożliwiające weryfikację informacji podanych w sprawozdaniu, uporządkowane chronologicznie, począwszy od najwcześniejszego zdarzenia gospodarczego:
a) historię rachunku bankowego, na którym są gromadzone środki finansowe komitetu wyborczego,
b) protokoły komisyjnej wyceny usług świadczonych nieodpłatnie na rzecz komitetu wyborczego, w tym dokumenty potwierdzające przyjęcie świadczeń niepieniężnych, o których mowa w art. 132 § 5 i art. 133 Kodeksu (w przypadku przyjęcia nieodpłatnego świadczenia usługi), w szczególności wykazy zawierające opis świadczenia i dane świadczącego lub umowy ze świadczącymi (w tym umowy użyczenia) oraz ich oświadczenia (w tym potwierdzające zgodę na eksponowanie materiałów wyborczych),
c) umowy, faktury, rachunki i inne dokumenty dotyczące kosztów i wydatków komitetu wyborczego, 
d) pokwitowania odbioru materiałów wyborczych przez komitet wyborczy, 
e) umowę rachunku bankowego, na którym są gromadzone środki finansowe komitetu wyborczego, 
f) umowy kredytu,
g) umowy poręczenia kredytu,
h) inne dokumenty umożliwiające weryfikację podanych w sprawozdaniu informacji.

“Documents to be attached to the financial report on the revenues, expenditures and financial liabilities of election committee: (…)
3) documents enabling verification of the information provided in the report, arranged chronologically, starting from the earliest economic event: 
a) the history of the bank account where the electoral committee’s financial resources are collected 
b) minutes of the commission’s valuation of services provided free of charge to the election committee, including documents confirming the receipt of non-monetary benefits referred to in Article 132 § 5 and Article 133 of the Code (in the case of accepting a free service), in particular lists containing a description of the service and data of the provider or agreements with providers (including of agreements of lending to use) and their declarations (including confirming consent to the display of election materials),
c) contracts, invoices, receipts, and other documents regarding the costs and expenditures of the election committee,
d) receipts for receipt of election materials by the election committee,
e) bank account agreement in which the election committee’ funds are deposited,
f) loan agreements,
g) loan guarantee agreements,
h) other documents enabling verification of the information provided in the report.”

Punkt 7. (…) Ze względu na charakter dowodowy do sprawozdania powinny być załączone oryginalne dokumenty źródłowe. W szczególności dotyczy to faktur, rachunków i innych dokumentów dotyczących kosztów i wydatków, chyba że nie zostały zapłacone do dnia złożenia sprawozdania. W tym wypadku powinna być załączona uwierzytelniona kserokopia tych dokumentów (…).
English translation:
“Point 7. (…) For evidentiary purposes, the report should be accompanied by original source documents. This particularly applies to invoices, receipts, and other documents relating to costs and expenditures, unless they have not been paid by the date of the report submission. In such cases, a certified photocopy of these documents should be attached (…).”

Political parties are obliged to submit to the National Election Commission annual reports on the sources of obtained funds and expenditures incurred from the Election Fund. This report covers expenditures from the Election Fund, which are limited to transfers to the accounts of election committees. Other expenditures are disclosed within the attached bank statements, if the payments were made through bank transfers.

Political parties that receive subvention submit to the National Election Commission information on the subvention received and expenditures incurred from this subvention. This information provides the cumulative amount for 11 types of expenditures, but 4 itemized lists that specifies only some of these expenses and allows to calculate only some of cumulates. Further details are disclosed within the bank statements attached to the political party’s annual report, if the payments were made through bank transfer.

For candidates, all campaign activities are conducted and financed exclusively through election committees. This also includes the preparation and submission of financial reports. These reports contain cumulative amounts for a number of types of expenditures and 8 lists used to calculate some of them. Importantly, reports must be submitted jointly with bank statements and the entirety of source documentation, that documents all expenditures.
