51. Is information in reports from political parties and/or candidates to be made public?

Art. 38.4. Państwowa Komisja Wyborcza ogłasza sprawozdanie wraz ze sprawozdaniem biegłego rewidenta, o którym mowa w ust. 3, w Biuletynie Informacji Publicznej, w terminie 30 dni od dnia upływu terminu określonego w art. 38 ust. 1. 
English translation:
“Art. 38.4. The National Election Commission publishes the report together with the report of the statutory auditor referred to in para. 3, in the Public Information Bulletin, within 30 days of the day of expiry of the deadline specified in art. 38, para. 1.”

§ 5, Rozporządzenie Ministra Finansów w sprawie sprawozdania o źródłach pozyskania środków finansowych 2023 (Ordinance of the Minister of Finance on the report on sources of obtaining financial resources 2023) 
§ 5. Sprawozdanie, w tym wykazy, o których mowa w sprawozdaniu, sporządza się w formie pisemnej w postaci: 
1) papierowej oraz opatruje własnoręcznym podpisem lub 
2) elektronicznej w formacie przeszukiwalnego pliku PDF oraz opatruje kwalifikowanym podpisem elektronicznym, podpisem zaufanym albo podpisem osobistym.

Ҥ 5. The report, including the lists referred to in the report, is prepared in writing in the following form:
1) on paper and signed by a handwritten signature, or
2) electronically in the form of a searchable PDF file and signed with a qualified electronic signature, a trusted signature, or a personal signature.”

Article 143, Kodeks wyborczy 2011 (Election Code 2011, consolidated text 2025)
Art. 143 § 1. W wyborach do Sejmu i do Senatu, wyborach do Parlamentu Europejskiego w Rzeczypospolitej Polskiej oraz wyborach Prezydenta Rzeczypospolitej Państwowa Komisja Wyborcza podaje do publicznej wiadomości w Biuletynie Informacji Publicznej sprawozdanie finansowe komitetu wyborczego w terminie 30 dni od dnia jego złożenia.
§ 2. Sprawozdania finansowe, o których mowa w § 1, Państwowa Komisja Wyborcza ogłasza w Dzienniku Urzędowym Rzeczypospolitej Polskiej „Monitor Polski” po upływie terminu, o którym mowa w § 1.
§ 3. Sprawozdania finansowe przedkładane komisarzowi wyborczemu są udostępniane przez niego na wniosek zainteresowanych podmiotów. Komisarz wyborczy podaje do publicznej wiadomości, w Biuletynie Informacji Publicznej, informację o miejscu, czasie i sposobie ich udostępniania do wglądu. 
§ 4. Wykaz wpłat obywateli polskich na rzecz komitetu wyborczego organizacji i komitetu wyborczego wyborców Państwowa Komisja Wyborcza i komisarz wyborczy udostępniają do wglądu na wniosek, w trybie i na zasadach określonych w przepisach o ochronie danych osobowych. 
§ 5. Pozostałe rodzaje dokumentów załączone do sprawozdań finansowych udostępniane są do wglądu podmiotom wymienionym w art. 144 § 7 w okresie przewidzianym na złożenie zastrzeżeń do sprawozdań finansowych, a pozostałym podmiotom udostępniane są po tym okresie na podstawie ustawy z dnia 6 września 2001 r. o dostępie do informacji publicznej.
English translation:
“Art. 143 § 1. In elections to the Sejm and Senate, elections to the European Parliament in the Republic of Poland, and elections of the President of the Republic of Poland, the National Election Commission makes public in the Public Information Bulletin the financial report of the election committee within 30 days of its submission.  
§ 2. The financial reports referred to in § 1 the National Election Commission publish in the Official Journal of the Republic of Poland, “Monitor Polski” after the deadline referred to in § 1.
§ 3. Financial reports submitted to the election commissioner are made available by this commissioner upon request of interested entities. Election commissioner makes public in the Public Information Bulletin information about the place, time, and manner of making them available for review. 
§ 4. The lists of payments of Polish citizens to the organization’s election committee and the voter’ election committee, the National Election Commission and the election commissar make available for review upon request, in the manner and under the terms specified in the provisions on personal data protection.
§ 5. Other types of documents attached to the financial statements are made available for review to the entities listed in art. 144 § 7 during the period provided for filing objections to financial statements, and are made available to other entities after this period pursuant to the law of 6 September 2001 on access to public information.”

Political party reports are published by the National Election Commission on its website of the Public Information Bulletin within 30 days of the submission deadline. Reports are published in PDF format or as hard copy scanned to PDF. Attachments are available for review under the Law on Access to Public Information.

In the case of candidates, all their campaign activities are conducted and financed exclusively through election committees. This also includes the preparation and submission of financial reports. These reports are published by the National Election Commission on its website of the Public Information Bulletin within 30 days of the submission deadline. After this deadline, these reports are published in the Official Journal of the Republic of Poland. Reports from local elections committees formed by political parties, although not explicitly listed as subject to publication, are published through the National Election Commission’s announcement and are certainly also subject to disclosure under the Law on the Access to Public Information. All these reports are published in PDF format or as hard copy scanned to PDF.

In the case of local election committees of organizations or voters that aimed to register candidates in only one voivodeship, and all committees formed for local by-elections, early elections or elections to a new council, reports must be submitted to and are made available for review by the relevant electoral commissar, depending on the committee’s headquarters.

All documents attached to the reports are available for review by entities authorized to file objections, and afterwards to all interested under the Law on Access to Public Information. Lists of donations are available for review under the terms of the provisions on personal data protection.
