47. Do political parties have to report regularly on their finances?

Article 38.1 and 3, ustawa o partiach politycznych 1997 (Law on Political Parties 1997, consolidated text 2023)
Art. 38.1. Partia polityczna składa Państwowej Komisji Wyborczej, nie później niż do 31 marca każdego roku, sprawozdanie o źródłach pozyskania środków finansowych, w tym o kredytach bankowych i warunkach ich uzyskania oraz o wydatkach poniesionych ze środków Funduszu Wyborczego w poprzednim roku kalendarzowym, zwane dalej „sprawozdaniem”. 
3. Do sprawozdania załącza się sprawozdanie biegłego rewidenta w zakresie wpływów na Fundusz Wyborczy partii politycznej. Biegłego rewidenta wybiera Państwowa Komisja Wyborcza (…). 
English translation:
“Art. 38.1. A political party submits to the National Election Commission, no later than 31 March of each year, a report on the sources of obtaining funds, including bank loans and the conditions for obtaining them, and on expenses incurred from the Election Fund in the previous calendar year, hereinafter referred to as “report”.
3. To the report is attached the auditor’s report that covers proceeds to the Election Fund of the political party. The auditor is selected by the National Election Commission (...).”

Article 34.1-2 and 4, ustawa o partiach politycznych 1997 (Law on Political Parties 1997, consolidated text 2023)
Art. 34.1. Partie polityczne sporządzają coroczną informację finansową o otrzymanej subwencji oraz o poniesionych z subwencji wydatkach, zwaną dalej „informacją”. 
2. Partie polityczne składają informację za rok kalendarzowy Państwowej Komisji Wyborczej w terminie do 31 marca następnego roku.
4. Informacja składana jest wraz z załączonym sprawozdaniem biegłego rewidenta, którego wybiera Państwowa Komisja Wyborcza (…).

“Art 34.1. Political parties prepare annual financial information on the received subvention and the expenses incurred from this subvention, hereinafter referred to as “information”. 
2. Political parties submit information for the calendar year to the National Election Commission by 31 March of the following year.
4. The information is submitted together with an attached report from an auditor selected by the National Election Commission (…)”

Article 25.6-11, ustawa o partiach politycznych 1997 (Law on Political Parties 1997, consolidated text 2023)
Art. 25.6. Partia polityczna jest obowiązana do prowadzenia i bieżącego aktualizowania rejestru wpłat. Rejestr wpłat jest zbiorczym zestawieniem informacji o środkach finansowych, o których mowa w ust. 1. 
7. Rejestr wpłat prowadzi się w formie elektronicznej. 
8. Partia polityczna udostępnia rejestr wpłat na swojej stronie podmiotowej Biuletynu Informacji Publicznej. 
9. W rejestrze wpłat zamieszcza się: 
1) imię, nazwisko, imię ojca oraz miejsce zamieszkania osoby dokonującej wpłaty; 
2) datę wpłaty; 
3) wysokość wpłaty. 
10. W rejestrze wpłat zamieszcza się informacje o wpłatach od osoby dokonującej wpłaty na rzecz partii politycznej, z wyłączeniem składek członkowskich, w kwocie przekraczającej w jednym roku 10 000 zł. 
11. Informacje w rejestrze wpłat zamieszcza się bez zbędnej zwłoki, nie później jednak niż w terminie 14 dni od dnia otrzymania wpłaty.
English translation:
“Art. 25.6. A political party is obliged to keep and update the register of payments on an ongoing basis. The register of payments is a collective statement of information on the financial resources referred to in para. 1.
7. The register of payments is kept in electronic form.
8. A political party publishes a register of payments on its website of the Public Information Bulletin.
9. In the register of payments is entered:
1) name, surname, father’s name and place of residence of the person making the payment;
2) date of payment;
3) the amount of payment. 
10. The register of payments include information on payments from the person making a payment to a political party, excluding membership fees, in the amount exceeding PLN 10 000 in one year.
11. Information in the register of payments is entered without undue delay, but not later than within 14 days from the day of receipt of the payment.”

Art. 27a 1. Partia polityczna jest obowiązana do prowadzenia i bieżącego aktualizowania rejestru umów. Rejestr umów jest zbiorczym zestawieniem informacji o umowach zawartych przez partię polityczną. 
2. Rejestr umów prowadzi się w formie elektronicznej. 
3. Partia polityczna udostępnia rejestr umów na swojej stronie podmiotowej Biuletynu Informacji Publicznej. 
6. W rejestrze umów zamieszcza się: 
1) numer umowy – o ile taki nadano; 
2) datę i miejsce zawarcia umowy; 
3) okres obowiązywania umowy; 
4) oznaczenie stron umowy, w tym przedstawicieli stron; 
5) określenie przedmiotu umowy; 
6) wartość przedmiotu umowy; 
7) tryb zawarcia umowy. 
7. W rejestrze umów zamieszcza się informacje o uzupełnieniu lub zmianie umowy, rozwiązaniu za zgodą stron umowy, jak również informacje o odstąpieniu od umowy, jej wypowiedzeniu lub wygaśnięciu. 
8. Informacje w rejestrze umów zamieszcza się bez zbędnej zwłoki, nie później jednak niż w terminie 14 dni od daty zawarcia umowy lub zaistnienia okoliczności określonej w ust. 7.

“Art. 27a 1. A political party is obliged to keep and update the register of contracts on an ongoing basis. The register of contracts is a summary of information about contracts concluded by a political party. 
2. The register of contracts is kept in electronic form. 
3. A political party provides a register of contracts on its website of the Public Information Bulletin.
6. In the register of contracts is entered: 
1) contract number – if given; 
2) date and place of conclusion of the contract; 
3) the duration of the contract; 
4) designation of the parties to the contract, including the parties’ representatives; 
5) specification of the subject of the contract; 
6) value of the subject of the contract; 
7) the procedure for concluding the contract. 
7. The register of contracts include information on supplementing or amending the contract, termination with the consent of the parties to the contract, as well as information on withdrawal from the contract, its termination or expiration. 
8. Information in the register of contracts is entered without undue delay, but not later than within 14 days from the date of conclusion of the contract or occurrence of the circumstances referred to in para. 7.”

Political parties submit to the National Election Commission a report on the sources of obtained funds and on expenditures incurred from the Election Fund in the previous calendar year. This report must be submitted annually, no later than by 31 March.

Political parties that received subvention submit to the National Election Commission financial information on the subvention received and expenditures incurred from this subvention. Information must be submitted annually, no later than by 31 March.

Furthermore, political parties are obliged to publish registers of donations and contracts on their websites of the Public Information Bulletin. These registers include information on donations exceeding PLN 10 000 in one year and contracts concluded, including bank loan contracts. Registers must be updated within 14 days of the donation, a new contract, or amendment to the contract.
