18. Is there a limit on the amount a donor can contribute to a candidate?

Art. 84 § 1. Prawo zgłaszania kandydatów w wyborach przysługuje komitetom wyborczym. Komitety wyborcze wykonują również inne czynności wyborcze, a w szczególności prowadzą na zasadzie wyłączności kampanię wyborczą na rzecz kandydatów.
English translation: 
“Art. 84 § 1. Election committees have the right to nominate candidates for elections. Election committees also perform other electoral activities, in particular, based on the principle of exclusivity, conduct election campaign for candidates.”

Art. 126. Wydatki ponoszone przez komitety wyborcze w związku z zarządzonymi wyborami są pokrywane z ich źródeł własnych.

“Point 2 (…) This means that all activities related to raising funds, making expenditures for organizing election meetings and promoting individual candidates in the form of posters, leaflets, etc., can only be conducted by election committees and only during the election campaign (…).”

Article 132 § 1-4, Kodeks wyborczy 2011 (Election Code 2011, consolidated text 2025)
Art. 132 § 1. Środki finansowe komitetu wyborczego partii politycznej mogą pochodzić wyłącznie z funduszu wyborczego tej partii, tworzonego na podstawie przepisów ustawy z dnia 27 czerwca 1997 r. o partiach politycznych.
§ 2. Środki finansowe koalicyjnego komitetu wyborczego mogą pochodzić wyłącznie z funduszy wyborczych partii politycznych wchodzących w skład koalicji wyborczej. 
§ 3. Środki finansowe: 
1) komitetu wyborczego organizacji, 
2) komitetu wyborczego wyborców 
– mogą pochodzić wyłącznie z wpłat obywateli polskich mających miejsce stałego zamieszkania na terenie Rzeczypospolitej Polskiej oraz kredytów bankowych zaciąganych wyłącznie na cele związane z wyborami. 
§ 4. Środki finansowe komitetu wyborczego kandydata na Prezydenta Rzeczypospolitej mogą pochodzić wyłącznie z wpłat obywateli polskich mających miejsce stałego zamieszkania na terenie Rzeczypospolitej Polskiej, z funduszy wyborczych partii politycznych oraz z kredytów bankowych zaciąganych na cele związane z wyborami.
English translation:
“Art. 132 § 1. The financial resources of the election committee of a political party may only come from the election fund of the party, created pursuant to the provisions of the Act of 27 June 1997 on Political Parties.
§ 2. The financial resources of the coalition election committee may only come from the election funds of the political parties comprising the electoral coalition.
§ 3. Financial resources of:
1) the election committee of an organization,
2) the election committee of voters
– may only come from payments of Polish citizens having permanent place of residence in the Republic of Poland and bank loans taken out solely for purposes related to elections.
§ 4. The financial resources of the election committee for the candidate for President of the Republic can only come from the payments of Polish citizens having permanent place of residence in the Republic of Poland, the election funds of political parties and bank loans taken out for purposes related to elections.”

Article 134 § 2, Kodeks wyborczy 2011 (Election Code 2011, consolidated text 2025)
Art. 134 § 2. Suma wpłat od obywatela polskiego na rzecz danego komitetu wyborczego nie może przekraczać 15-krotności minimalnego wynagrodzenia za pracę, ustalanego na podstawie odrębnych przepisów, obowiązującego w dniu poprzedzającym dzień ogłoszenia aktu o zarządzeniu wyborów. 
English translation: 
“Art. 134 § 2. The sum of payments from a Polish citizen for the election committee may not exceed 15 times the minimum wage, determined pursuant to separate provisions, in force on the day preceding the day of announcement of the act on ordering the elections.”

Election campaigns are conducted and financed exclusively through election committees, not individual candidates. Committees in particular conduct campaigns for candidates and manage the entirety of the related financial economy. For these reasons this question is answered through the lens of the provisions dedicated to election committees.

Donations from legal persons are not allowed. Donations from natural persons are permitted only from Polish citizens having permanent place of residence in the Republic of Poland.

Donors can contribute only to the election committee of an organization, the election committee of voters and the election committee of a candidate for President of the Republic, and the allowed limit is 15 times the minimum wage.

Need to be aware that election committees formed by political parties can receive financial resources only through the Election Funds of the parties that formed them. For these reasons, and to finance these committees, there is practice to make individual donations to the political party’s current account and/or its Election Fund with the aim to have this transferred to the given committee.
