31. What are the provisions on 'ear marking' direct public funding to political parties (how it should be used)?

Artículo 207. El financiamiento preelectoral estará destinado a contribuir con los gastos de campaña electoral de los candidatos por libre postulación y partidos políticos que decidan participar en las elecciones generales, dicho financiamiento será el 50% del total financiamiento público asignado a las respectivas elecciones y se distribuirá según se dispone en los siguientes artículos.

Artículo 208. El 7 % del monto correspondiente al financiamiento preelectoral se asignará a los candidatos por libre postulación para ser invertido por estos en propaganda electoral y gastos de campaña; y se repartirá así: dos terceras partes para los tres candidatos presidenciales y un tercio para los candidatos a los demás cargos. El monto correspondiente se repartirá en función de las firmas válidas obtenidas por cada uno de ellos.

Artículo 210. El 93 % del monto correspondiente al financiamiento preelectoral, se asignará a todos los partidos políticos que participarán en las elecciones, para ser invertido en propaganda electoral y gastos de campaña, por conducto del Tribunal Electoral, de conformidad con las normas de este capítulo.

Artículo 214. El financiamiento poselectoral será destinado a contribuir con los gastos de funcionamiento y capacitación, según se dispone en esta sección.

Artículo 218. A cada partido político se le entregará un aporte fijo igualitario y un aporte con base en los votos, según se explica a continuación:
1.Aporte fijo igualitario. El aporte fijo igualitario identificado en el numeral 2 del artículo 216, se repartirá por partes iguales a los partidos que hayan subsistido, para contribuir al financiamiento de sus gastos de funcionamiento. El dinero que cada partido tiene derecho a recibir por el aporte igualitario será entregado por el Tribunal Electoral trimestralmente durante cinco años, en anualidades iguales, adelantando siempre un trimestre, el primero de los cuales se inicia el 1 de julio del año de las elecciones. Este aporte será consignado en la cuenta bancaria de funcionamiento del partido político en el Banco Nacional de Panamá o en la Caja de Ahorros.
2. Aporte con base en los votos. El aporte con base en votos identificado en el artículo 216, se dividirá en 60 % para gastos de funcionamiento y 40 % para gastos de capacitación, y se le entregará trimestralmente en cinco anualidades iguales, adelantando siempre un trimestre, el primero de los cuales se inicia el 1 de julio del año de las elecciones. El monto correspondiente a funcionamiento puede incluir inversiones como compra de inmuebles para sedes partidarias y vehículos. Este aporte será consignado en la cuenta bancaria de funcionamiento del partido político en el Banco Nacional de Panamá o en la Caja de Ahorros. El monto correspondiente a capacitación se destinará para:
- a) Actividades de educación cívico-política con énfasis en la enseñanza de la democracia, la importancia del Estado de derecho, del papel que deben jugar las autoridades elegidas mediante el voto popular en una sociedad democrática, participativa, inclusiva y representativa de los principios y programas de gobierno de cada partido, en relación con los aspectos económicos, políticos, sociales y culturales de la Nación, así como de la interculturalidad de los pueblos. De este fondo de capacitación se destinará un mínimo de 20 % para el desarrollo de actividades exclusivas para la capacitación de mujeres, un 20 % para el desarrollo de actividades exclusivas para la juventud, y un 10 % en la formación sobre acciones políticas inclusivas en pro del empoderamiento de personas con discapacidad, a fin de potenciar el ejercicio pleno de sus derechos políticos, activos y pasivos, las cuales serán manejadas en cuentas bancarias separadas en el Banco Nacional de Panamá o en la Caja de Ahorros por las respectivas secretarías o su equivalente, con la supervisión y fiscalización de la Junta Directiva del partido. Cuando en el estatuto de los partidos políticos se establezca una asignación de fondos públicos a otras secretarías o su equivalente, que formen parte de la estructura del partido, estos deberán manejarse de la misma forma que se indica en el párrafo anterior.
- b) Realización periódica de elecciones de autoridades locales y actividades consultivas, organizacionales y de bases, con el fin de contribuir con el fortalecimiento de su democracia interna.
Todos los gastos de funcionamiento poselectoral serán manejados según lo reglamente el Tribunal Electoral y sujetos a su auditoría.

Article 207. The pre-electoral financing shall be destined to contribute to the electoral campaign expenses of the candidates by independent nomination and political parties that decide to participate in the general elections, said financing shall be 50% of the total public financing assigned to the respective elections and shall be distributed as provided in the following articles.

Article 208. 7% of the amount corresponding to the pre-electoral financing shall be assigned to the candidates for independent nomination to be invested by them in electoral propaganda and campaign expenses; and it shall be distributed as follows: two thirds for the three presidential candidates and one third for the candidates for the other offices. The corresponding amount shall be distributed according to the valid signatures obtained by each one of them.

Article 210. 93% of the amount corresponding to pre-electoral financing shall be allocated to all political parties that shall participate in the elections, to be invested in electoral propaganda and campaign expenses, through the Electoral Tribunal, in accordance with the provisions of this Chapter.

Article 214. The post-electoral financing shall be destined to contribute to the operating and training expenses, as provided in this section.

Article 218. Each political party shall be given a fixed equal contribution and a contribution based on votes, as explained below:
1. Equal fixed contribution. The equal fixed contribution identified in numeral 2 of Article 216, shall be distributed in equal parts to the parties that have subsisted, to contribute to the financing of their operating expenses. The money that each party is entitled to receive for the equal contribution shall be delivered by the Electoral Tribunal quarterly during five years, in equal annuities, always advancing one quarter, the first of which begins on July 1 of the year of the elections. This contribution shall be deposited in the operating bank account of the political party in the Banco Nacional de Panama or in the Caja de Ahorros.
2. Contribution based on votes. The contribution based on votes identified in article 216, shall be divided into 60% for operating expenses and 40% for training expenses, and shall be delivered quarterly in five equal annual installments, always advancing one quarter, the first of which begins on July 1 of the year of the elections. The amount corresponding to operation may include investments such as the purchase of real estate for party headquarters and vehicles. This contribution shall be deposited in the operating bank account of the political party in the Banco Nacional de Panamá or in the Caja de Ahorros. The amount corresponding to training shall be destined for:
- a) Civic-political education activities with emphasis on the teaching of democracy, the importance of the rule of law, of the role to be played by the authorities elected by popular vote in a democratic, participatory, inclusive and representative society of the principles and government programs of each party, in relation to the economic, political, social and cultural aspects of the Nation, as well as the interculturality of the peoples. From this training fund a minimum of 20% shall be allocated for the development of exclusive activities for the training of women, 20% for the development of exclusive activities for the youth, and 10% for training on inclusive political actions for the empowerment of persons with disabilities, in order to enhance the full exercise of their political rights, active and passive, which shall be managed in separate bank accounts in the Banco Nacional de Panama or in the Caja de Ahorros by the respective secretariats or their equivalent, with the supervision and oversight of the Board of Directors of the party. When the statute of the political parties establishes an allocation of public funds to other secretariats or their equivalent, which are part of the party structure, these shall be managed in the same manner as indicated in the preceding paragraph.
- b) Periodic holding of elections of local authorities and consultative, organizational and grassroots activities, in order to contribute to the strengthening of its internal democracy.
All post-electoral operating expenses shall be managed as regulated by the Electoral Tribunal and subject to its audit.

The use of public funds is strictly earmarked and differs for the two types of financing:
- Pre-Electoral Financing: This is earmarked exclusively for "electoral propaganda and campaign expenses" for both political parties and independent candidates.
- Post-Electoral Financing: This is divided between "operating expenses" and "training expenses". Operating expenses can include investments like purchasing property for party headquarters. Training funds are further earmarked for civic-political education, with specific minimum percentages allocated for the training of women (20%), youth (20%), and people with disabilities (10%).
