(ii) Legal Framework and Electoral System
(...) The AUEOM noted that Malawi’s legal framework is generally in line with international, continental, and regional norms and standards for the conduct of democratic elections, including the ACDEG, the COMESA and SADC Principles and Guidelines. Further, the legal framework recognises and guarantees fundamental rights and freedoms, including freedom of speech, association, movement and political participation. However, enforcement gaps remain, particularly in campaign finance oversight, the absence of binding gender quotas and the lack of diaspora voting, which limit full compliance with regional and international commitments.
