Article 106 Voting

1. After receiving the ballot, the voter enters alone into the secret room and marks on the ballot in the place designated by the ballot for the electoral subject and/or the preferred candidate of the electoral subject the sign “x” or “+” or another sign that clearly indicates the choice made by him.
2. The voter, after making the mark on the ballot, folds the ballot so that the mark is not visible, but at least one of the stamps on the back of the ballot is visible. The voter, after leaving the secret room, places the ballot paper in the appropriate ballot box and leaves the voting center.
3. The voter votes only for himself, except for the case provided for in Article 108 of this Code.
4. The members and the secretary of the VCC vote after all the voters present at the voting center have voted within the voting closing time. The rules provided for in this Article also apply to the voting of the members and the secretary of the VCC.
5. The members of the VCC who have allowed a voter to vote more than once or on behalf of other voters, shall bear criminal liability, in accordance with Article 324/a of the Criminal Code, except for the case provided for in Article 108 of this Code.

Article 162 Calculation of mandates of electoral entities (...dated 26.7.2024):
1. No later than 3 days from the end of the appeal process against the decision to approve the results of the electoral zone or the invalidity of the elections, according to this Code, the CEC shall calculate
the distribution of mandates for each electoral zone, based on the number of valid votes that the entities have received at the electoral zone level. For the elections to the Assembly, political parties or coalitions that have received less than 1 percent of the valid votes at the national level are excluded from the distribution of mandates.
2. The number of valid votes at the electoral zone level of each subject is divided continuously by consecutive natural numbers, called divisors, starting with the number 1 and ending with the natural number corresponding to the number of mandates distributed in the respective electoral zone. The step from one divisor to the next is 1. If the quotient obtained from the division is a number with a decimal remainder, the nearest whole number is taken as the quotient. 3. When the electoral subject is a candidate proposed by the voters, its votes are divided only by the divisor 1. 4. The divisors obtained from each division, including the result of point 3 of this article, are listed from the largest quotient to the smallest, listing next to them the subject to which the respective quotient belongs. If the quotient is a number with a decimal remainder, the nearest whole number is taken as the quotient. The ranking continues until they are ranked as many times as the number of mandates distributed in the respective electoral zone.
5. An electoral subject receives a number of mandates equal to the number of quotients included in the list specified in point 4 of this article. In the event that for the last place in the list specified in point 4 of this article, two or more subjects with the same quotient result, the mandate is given to the subject with the highest number of votes and if they have an equal number of votes, then it is determined by drawing lots between those subjects. The draw is held publicly at the CEC, in the presence of the interested subjects.

Article 163 Distribution of mandates for winning candidates on the list

1. Immediately after the completion of the calculation of the result, according to Article 162 of this Code, the CEC calculates the distribution of mandates for the winning candidates for each electoral subject.
2. The candidates on the multi-name list who are subject to preferential voting are re-ranked based on the highest number of preferential votes for each candidate. When the number of votes is equal, the ranking is determined by drawing lots. The re-ranking according to this point is used in the implementation of Article 164 of this Code. In cases where the re-ranking does not result from the fact that, starting from the head of this list, one in every three names belongs to the less represented gender, then the third candidate on this list and subsequently one in every three names thereof belongs to the less represented gender according to the number of votes that the latter have received. Based on this criterion, the final list subject to preferential voting, ranked, is drawn up, which is used for the implementation of Article 164 of this Code.
3. The mandates for the winning candidates are initially distributed according to the ranking of the multi-name list with a fixed ranking of the electoral subject and in accordance with the ranking of the candidates in it and, in case of its exhaustion, it is continued with the re-ranked winning candidates of the multi-name list subject to preferential voting according to point 2 of this Article.
4. The calculation and distribution of mandates, according to Article 162 and this Article, for each electoral zone is approved by decision. The decision is approved for each electoral zone separately. An administrative appeal against the decision may be filed with the CAS.
