12. Limits to contributions
(1) The Commission shall, at least twelve months before a general election, by
notice in the Gazette, prescribing limits on—
(c) paid-up media coverage;

20. Media coverage
(1) The Commission shall, after consultations with political parties, the officers
responsible for the state-owned media enterprises and authorities responsible for the regulation of media in Kenya, set out the limit of media coverage of a candidate, political party or a referendum committee, which shall include—
(a) paid-up advertisement; and
(b) free broadcasting spots or coverage in the print media.

Comment

The Election Campaign Finance Act envisages spending limits and requires the EMB to develop expenditure ceilings that require parliament approval. However, thus far, parliament has been rejecting the proposed limits.
