(1) Finansiranje političkih stranaka zabranjuje se:  a) organima uprave države Bosne i Hercegovine, entiteta, kantona, Brčko Distrikta Bosne i Hercegovine, te gradskim i općinskim organima,  b) javnim institucijama,  c) javnim preduzećima,  d) humanitarnim organizacijama,  e) neimenovanim, odnosno anonimnim donatorima,  f) vjerskim zajednicama,  g) sindikatima, udruženjima i drugim neprofitnim organizacijama koje se finansiraju javnim sredstvima bez obzira na iznos sredstava,  h) pravnim licima u kojima uloženi javni kapital iznosi najmanje 25%,   i) drugim državama, stranim političkim strankama i stranim pravnim licima.  (2) Zabrana iz stava (1) tačke a) ovog člana ne odnosi se na korištenje poslovnih prostorija, koje političke stranke koriste na osnovu odluke nadležnog organa.  (3) Izuzetno, zabrana finansiranja političkih stranaka iz stava (1) tačke i) ovog člana ne odnosi se na finansiranje programa namijenjenih za edukaciju, a s ciljem razvoja i promoviranja demokratskih principa. (4) Privatna preduzeća koja su s organima izvršne vlasti na svim nivoima u Bosni i Hercegovini sklopila ugovor o javnoj nabavci usluga, ugovor o javnoj nabavci robe ili ugovor o javnoj nabavci radova, u skladu s propisima o javnim nabavkama u Bosni i Hercegovini, ne mogu finansijski pomagati političke stranke ako vrijednost ugovora u jednoj kalendarskoj godini prelazi iznos od 10.000,00 KM (deset hiljada konvertibilnih maraka).   (5) Političke stranke ne mogu ostvarivati prihode od imovine koja nije u njihovom vlasništvu. (6) Zabranjeno je davanje dobrovoljnih priloga u novcu ili u formi proizvoda posredstvom trećih lica (posrednika).  (7) Eventualni dobrovoljni prilozi uplaćeni na račun političke stranke iz nedopuštenih izvora prema st. (1) i (6) ovog člana, kao i iznosi dobrovoljnih priloga koji prelaze iznose utvrđene u  članu 6. ovog zakona, te eventualne uplate dobrovoljnih priloga od neimenovanih, odnosno  anonimnih izvora, politička stranka dužna je uplatiti u korist budžeta BiH, najkasnije u roku  osam dana od dana primljene uplate, te o tome obavijestiti Centralnu izbornu komisiju Bosne  i Hercegovine.

(4) Private companies that have concluded a public procurement contract for services, goods, or works with executive authorities at any level in Bosnia and Herzegovina, in accordance with public procurement regulations in Bosnia and Herzegovina, may not provide financial support to political parties if the value of the contract in a single calendar year exceeds 10,000 KM (ten thousand convertible marks). (5) Political parties may not generate income from property that is not owned by them.(6) It is prohibited to make voluntary contributions in money or in the form of goods through third parties (intermediaries). (7) Any voluntary contributions paid into the account of a political party from prohibited sources under paragraphs (1) and (6) of this Article, as well as voluntary contributions exceeding the amounts established in Article 6 of this Law, and any voluntary contributions from unnamed or anonymous sources, must be transferred by the political party to the budget of Bosnia and Herzegovina no later than eight days from the date of receipt, and the Central Election Commission of Bosnia and Herzegovina must be notified thereof.

Nadležni organi neće dozvoliti političkim strankama, koalicijama, listama nezavisnih kandidata  i nezavisnim kandidatima da postavljaju oglase, plakate, postere, odnosno da pišu svoja imena ili  slogane koji su u vezi sa izbornom kampanjom, unutar ili na zgradama u kojima su smješteni  organi vlasti na svim nivoima, javna preduzeća, javne ustanove i mjesne zajednice, na vjerskim  objektima, na javnim putevima, i javnim površinama, osim na mjestima predviđenim za  plakatiranje i oglašavanje.

(1) Nosiocima izvršne funkcije utvrđenim u članu 1.8, stav (6) ovog zakona i nosiocima mandata zabranjena je zloupotreba javnih sredstava. (2) Zloupotrebu javnih sredstava u smislu stava (1) ovog člana između ostalog podrazumijeva: a) korištenje pozicije rukovodioca organa ili ustanove za javnu promociju kandidata i/ili političkog subjekta kojem pripada, kroz javnu promociju organa ili ustanove; b) uključivanje državnih službenika koji su podređeni kandidatu u obavljanju poslova u radnom vremenu s ciljem promocije kandidata ili političkih subjekata; c) korištenje prostorija javnih ustanova, organa ili javnih preduzeća za obavljanje predizbornih aktivnosti ako korištenje istih prostorija nije zagarantovano drugim kandidatima i političkim subjektima pod istim uslovima; d) korištenje sredstava komunikacije, informacionih usluga, kancelarijske opreme javnih ustanova, organa i javnih preduzeća za izbornu kampanju e) korištenje sredstava prevoza u vlasništvu državnih, entitetskih, gradskih, kantonalnih ili opštinskih organa i organizacija bez naknade ili ro sniženim naknadama za aktivnosti kampanje. Ova odredba ne odnosi se na prevoz osoba pod posebnom zaštitom u skladu sa zakonom, koji se obavlja kao dio sigurnosnih mjera koje se primjenjuju na visoke zvaničnike koji podliježu službenoj zaštiti koju pružaju nadležni organi prilikom obavljanja službene dužnosti ili postupanja ro službenoj dužnosti; f) promocija političkih subjekata ili kandidata na javnim događajima ili manifestacijama koje finansiraju javne institucije ili javna poduzeća; g) prikupljanje potpisa ili vođenje izborne kampanje koju provode lica koja obavljaju izbornu dužnost ili su državni službenici, tokom službenih aktivnosti ili događaja koje organizuje javna institucija, javni organ ili javno preduzeće; i h) korištenje javnih sredstava i resursa u svrhu direktne ili indirektne kupovine podrške birača tokom izborne kampanje, što uključuje između ostalog i pružanje jednokratne novčane ili nenovčane pomoći građanima ili kategorijama građana, osim ako je pružanje te pomoći planirano u okviru redovnih budžetskih subvencija.

The competent authorities shall not allow political parties, coalitions, lists of independent candidates, and independent candidates to place advertisements, posters, or banners, or to write their names or slogans related to the election campaign inside or on the buildings housing government bodies at all levels, public enterprises, public institutions, and local communities, on religious buildings, on public roads, and public areas, except in places designated for posting and advertising.

(1) Holders of executive functions defined in Article 1.8, paragraph (6) of this Law, as well as holders of mandates, are prohibited from misusing public resources. (2) Misuse of public resources, within the meaning of paragraph (1) of this Article, includes, among other things:

This provision does not apply to the transportation of persons under special protection in accordance with the law, when carried out as part of security measures applied to high-ranking officials subject to official protection provided by the competent authorities while performing official duties or acting in an official capacity; f) promoting political entities or candidates at public events or manifestations financed by public institutions or public enterprises; g) collecting signatures or conducting election campaign activities by persons performing electoral duties or who are civil servants, during official activities or events organized by a public institution, authority, or public enterprise; and h) using public funds and resources for the purpose of directly or indirectly buying voter support during the election campaign, which includes, among other things, providing one-time financial or non-financial assistance to citizens or categories of citizens, unless such assistance is planned within regular budget subsidies.

(1) U budžetu institucija Bosne i Hercegovine i međunarodnih obaveza Bosne i Hercegovine (u daljnjem tekstu: budžet BiH) osiguravaju se sredstva za finansiranje političkih stranaka, odnosno koalicija političkih stranaka i nezavisnih kandidata zastupljenih u Parlamentarnoj skupštini Bosne i Hercegovine i parlamentarnih grupa, odnosno klubova poslanika i delegata u Parlamentarnoj skupštini Bosne i Hercegovine.  (2) Ukupna sredstva iz stava (1) ovog člana ne mogu prelaziti iznos od 0,2% budžeta BiH u kalendarskoj godini.  (3) Političkim strankama, odnosno koalicijama političkih stranaka sredstva iz stava (1) ovog člana raspodjeljuju se na način da se:   a) 30% sredstava dijeli jednako svim političkim strankama, odnosno koalicijama političkih  stranaka koje su osvojile mandate,  b) 60% sredstava dijeli prema broju poslaničkih, odnosno delegatskih mandata, koje svaka politička stranka, koalicija političkih stranaka, odnosno nezavisni kandidat ima u trenutku dodjele mandata,  c) 10% od ukupnog iznosa raspoređuje parlamentarnim grupama srazmjerno broju poslaničkih, odnosno delegatskih mjesta koja pripadaju manje zastupljenom spolu.  (4) Članovi koalicije političkih stranaka učestvuju u raspodjeli sredstava iz stava 3. ovog člana na osnovu sporazuma za raspodjelu novčanih sredstava, koji je deponiran u Centralnoj izbornoj komisiji Bosne i Hercegovini, a ako takav sporazum ne postoji, sredstva se raspoređuju između članica koalicije političkih stranaka prema broju dobivenih mandata. (5) Parlamentarne grupe, odnosno klubovi poslanika i delegata i nezavisni kandidati u Parlamentarnoj skupštini Bosne i Hercegovine učestvuju u raspodjeli sredstava iz stava (3) tačka b) ovog člana prema broju poslaničkih, odnosno delegatskih mandata u domovima Parlamentarne skupštine Bosne i Hercegovine.  (6) Zajednička komisija za administrativne poslove Parlamentarne skupštine Bosne i Hercegovine će svojim aktima detaljnije regulirati raspodjelu sredstava iz ovog člana, kontrolu trošenja i druga finansijska pitanja u vezi s provođenjem ovog zakona.

(1) The budget of the institutions of Bosnia and Herzegovina and the international obligations of Bosnia and Herzegovina (hereinafter: the BiH budget) shall provide funds for financing political parties, namely coalitions of political parties and independent candidates represented in the Parliamentary Assembly of Bosnia and Herzegovina, as well as parliamentary groups or caucuses of deputies and delegates in the Parliamentary Assembly of Bosnia and Herzegovina. (2) The total funds referred to in paragraph (1) of this Article may not exceed 0.2% of the BiH budget in a calendar year. (3) Funds from paragraph (1) of this Article shall be distributed to political parties or coalitions of political parties as follows: a) 30% of the funds shall be distributed equally among all political parties or coalitions of political parties that have won mandates, b) 60% of the funds shall be distributed according to the number of deputy or delegate mandates held by each political party, coalition of political parties, or independent candidate at the time of mandate allocation, c) 10% of the total amount shall be allocated to parliamentary groups in proportion to the number of deputy or delegate seats held by the underrepresented gender. (4) Members of a coalition of political parties shall participate in the distribution of funds from paragraph 3 of this Article based on an agreement on the allocation of funds, which shall be deposited with the Central Election Commission of Bosnia and Herzegovina. If such an agreement does not exist, funds shall be distributed among coalition members according to the number of mandates obtained  (5 Parliamentary groups or caucuses of deputies and delegates, as well as independent candidates in the Parliamentary Assembly of Bosnia and Herzegovina, shall participate in the distribution of funds from paragraph (3), item b) of this Article according to the number of deputy or delegate mandates in the chambers of the Parliamentary Assembly of Bosnia and Herzegovina. (6) The Joint Committee for Administrative Affairs of the Parliamentary Assembly of Bosnia and Herzegovina shall regulate in detail, through its acts, the distribution of funds under this Article, the control of their use, and other financial matters related to the implementation of this Law.

U roku od sedam dana od zaključivanja Centralnog biračkog spiska, Centralna izborna komisija BiH objavljuje broj birača za svaku izbornu jedinicu. Taj broj je osnov za određivanje maksimalnog iznosa sredstava koji politički subjekt može potrošiti za finansiranje izborne kampanje. Maksimalno dozvoljeni iznos za finansiranje troškova izborne kampanje za izbore izračunava se tako da se broj birača u svim izbornim jedinicama u kojima politički subjekt iz stava (1) ovog člana ima kandidatsku listu ili kandidata pomnoži sa: 1) 30 feninga za izbore za načelnika opštine /gradonačelnika i za članove opštinskog vijeća/ skupštine opštine 2) 20 feninga za izbore za članove kantonalnih skupština 3) 30 feninga za izbore za članove Narodne skupštine RS i Predstavničkog doma Parlamenta Federacije BiH 4) 30 feninga za izbore za članova Parlamentarne skupštine BiH 5) 30 feninga za izbore za članove Predsjedništva BiH 6) 30 feninga za izbore za predsjednika i potpredsjednike RS. U slučaju ponavljanja izbora u izbornoj jedinici, odnosno biračkom mjestu troškovi izborne kampanje po biraču mogu iznositi do 30% troškova poništenih izbora u izbornoj jedinici odnosno biračkom mjestu.

Within seven days from the finalization of the Central Voters’ Register, the Central Election Commission of BiH shall publish the number of voters for each electoral unit. This number serves as the basis for determining the maximum amount of funds that a political entity may spend on financing the election campaign. The maximum permitted amount for financing election campaign expenses is calculated by multiplying the number of voters in all electoral units in which the political entity referred to in paragraph (1) of this Article has a candidate list or candidate, by:
0.30 BAM (30 fening) for elections for municipal mayors and members of municipal councils/assemblies,
0.20 BAM (20 fening) for elections for members of cantonal assemblies,
0.30 BAM (30 fening) for elections for members of the National Assembly of RS and the House of Representatives of the Parliament of the Federation of BiH,
0.30 BAM (30 fening) for elections for members of the Parliamentary Assembly of BiH,
0.30 BAM (30 fening) for elections for members of the Presidency of BiH,
0.30 BAM (30 fening) for elections for the president and vice presidents of RS.
For elections referred to in paragraph (2), item 1 of this Article, in municipalities where the number of voters entered in the Central Voters’ Register is less than 3,000, it shall be considered that 3,000 voters are registered.
In the case of repeat elections in an electoral unit or polling station, election campaign expenses per voter may amount to up to 30% of the expenses of the annulled elections in that electoral unit or polling station.

U periodu preuranjene izborne kampanje zabranjeno je vođenje izborne kampanje u elektronskim, onlajn i štampanim medijima i putem društvenih mreža ili bilo koji oblik javnog oglašavanja kampanje. Ova zabrana ne odnosi se na organizovanje zakonitih zvaničnih skupova organa i događaja političkih subjekata u svrhe koje nisu kampanja.

Onlajn mediji koji se opredijele za izvještavanje o izbornoj kampanji dužni su osigurati javne i transparentne informacije o svom vlasništvu i pridržavati se principa kako su propisani u članu 16.2 stav (1) ovog zakona.

During the early election campaign period, it is prohibited to conduct election campaigns in electronic, online and print media and via social networks or any form of public advertising campaign. This prohibition does not apply to the organization of lawful official gatherings of bodies and events of political entities for purposes other than campaigning.

(2) Online media outlets that are allocated for reporting on the election campaign are obliged to provide public and transparent information about their ownership and adhere to the principles as prescribed in Article 16.2 paragraph (1) of this Law.

This report shall contain the information specified in the Election Law of Bosnia and Herzegovina. (1) Finansiranje političkih stranaka zabranjuje se:  
a) organima uprave države Bosne i Hercegovine, entiteta, kantona, Brčko Distrikta Bosne i Hercegovine, te gradskim i općinskim organima,   b) javnim institucijama,  c) javnim preduzećima,  d) humanitarnim organizacijama,   e) neimenovanim, odnosno anonimnim donatorima,  f) vjerskim zajednicama,  g) sindikatima, udruženjima i drugim neprofitnim organizacijama koje se finansiraju javnim sredstvima bez obzira na iznos sredstava,   h) pravnim licima u kojima uloženi javni kapital iznosi najmanje 25%,   i) drugim državama, stranim političkim strankama i stranim pravnim licima.

(6) Zabranjeno je davanje dobrovoljnih priloga u novcu ili u formi proizvoda posredstvom  trećih lica (posrednika). 
(7) Eventualni dobrovoljni prilozi uplaćeni na račun političke stranke iz nedopuštenih izvora prema st. 1) The financing of political parties is prohibited from: a) administrative bodies of the state of Bosnia and Herzegovina, the entities, cantons, the Brčko District of Bosnia and Herzegovina, as well as city and municipal bodies, b) public institutions, c) public enterprises, d) humanitarian organizations, e) unnamed or anonymous donors, f) religious communities, g) trade unions, associations, and other non-profit organizations financed from public funds, regardless of the amount of such funds, h) legal entities in which invested public capital amounts to at least 25%, i) other states, foreign political parties, and foreign legal entities.

(7) Any voluntary contributions paid into the account of a political party from prohibited sources under paragraphs (1) and (6) of this Article, as well as voluntary contributions exceeding the amounts established in Article 6 of this Law, and any voluntary contributions from unnamed or anonymous sources, must be transferred by the political party to the budget of Bosnia and Herzegovina no later than eight days from the date of receipt, and the Central Election Commission of Bosnia and Herzegovina must be notified thereof.

(1) Politička stranka obavezna je imenovati ovlašteno lice koje je odgovorno za vođenje poslovnih knjiga političkih stranaka, podnošenje finansijskih izvještaja i koje je ovlašteno da kontaktira s Centralnom izbornom komisijom Bosne i Hercegovine. (2) Podnosilac izvještaja obavještava Centralnu izbornu komisiju Bosne i Hercegovine o imenovanju ovlaštenog lica iz stava (1) ovog člana u roku od 15 dana od njegovog imenovanja i u slučaju bilo kakve promjene statusa tog lica dužni su u roku od 15 dana obavijestiti Centralnu izbornu komisiju Bosne i Hercegovine o toj promjeni. (3) Ovlašteno lice potpisuje sve izvještaje i odgovorno je za vođenje evidencije u vezi sa izvještajima, a na zahtjev Centralne izborne komisije Bosne i Hercegovine, ovlašteno lice obavezno je dostaviti izvještaje na uvid. (4) Političke stranke čuvaju sve svoje finansijske izvještaje najmanje šest godina nakon podnošenja. (5) Centralna izborna komisija Bosne i Hercegovine sve izvještaje stavlja na raspolaganje javnosti putem svoje veb-stranice i preduzima odgovarajuće mjere da bi se osiguralo da svi građani imaju pristup informacijama koje su sadržane u izvještajima. (6) Politička stranka dužna je javno prikazati porijeklo i način utroška sredstava prikupljenih tokom protekle kalendarske godine (računovodstvene godine). Završni račun i finansijski izvještaj u kojem se podrobno navode izvori prihoda, podaci o fizičkim i pravnim licima koja su dala dobrovoljne priloge te podaci o namjeni, odnosno aktivnostima za koje su sredstva utrošena, javni su dokumenti i objavljuju se na veb stranici političke stranke.

(1) A political party is required to appoint an authorized person responsible for maintaining the party’s business records, submitting financial reports, and serving as the authorized contact with the Central Election Commission of Bosnia and Herzegovina. (2) The reporting entity shall notify the Central Election Commission of Bosnia and Herzegovina of the appointment of the authorized person referred to in paragraph (1) of this Article within 15 days of the appointment, and in the event of any change in the status of that person, it shall notify the Central Election Commission of Bosnia and Herzegovina within 15 days of such change. (3) The authorized person shall sign all reports and is responsible for keeping records related to the reports. Upon request of the Central Election Commission of Bosnia and Herzegovina, the authorized person is obliged to submit the reports for inspection. (4) Political parties shall keep all their financial reports for at least six years after submission. (5) The Central Election Commission of Bosnia and Herzegovina shall make all reports available to the public through its website and shall take appropriate measures to ensure that all citizens have access to the information contained in the reports. (6) A political party is obliged to publicly disclose the origin and use of funds collected during the previous calendar year (financial year). The final account and financial report, which detail the sources of income, information on natural and legal persons who made voluntary contributions, and data on the purpose and activities for which the funds were spent, are public documents and shall be published on the political party’s website.

Prijava za učešće na izborima političke partije i nezavisnog kandidata neće biti ovjerena ako politička partija i nezavisni kandidat ne podnesu finansijski izvještaj za period koji počinje tri mjeseca prije početka perioda za podnošenje prijave za ovjeru.

The total amount of all account payables and total amount of disbursements in the following categories: costs for printing and distribution of posters, printing costs for preelection announcements, statements and so on, in the public media, organizational and operational costs for organizing rallies, costs for printing, reproducing and delivering pre-election materials directly to voters, and 5. the amount and nature of outstanding debts and obligations owed by or to the person who files a report and where such debts and obligations are settled for less than their reported amount or value, a statement as to the circumstances and conditions under which such debts or obligations were extinguished.

In addition, no later than thirty (30) days after the election results are published in the Official Gazette of BIH, a financial report shall be submitted to the Central Election Commission of BiH for the period beginning on the day of submission of the application for certification until the certification of the results. These reports shall contain the following: 1. All cash at hand; 2. All income and disbursements based on: memberships; transparent contributions from abroad; contributions from individual and legal entities; contributions in the form of goods and services (hereinafter referred to as “in-kind contributions”); returns on its own assets and entrepreneurial activities in accordance with provisions of the Law on Political Party Financing ; credits; loans; donations; rebates; refunds; other operating expenditures; and other sources for the reporting period as determined by the Central Election Commission of BiH; 3. Identification of the person or source of any payment and in-kind contribution, as well as the identification of a person who received that payment, in excess of one hundred (100) convertible marks, together with the date and amount of any such receipt; 4. The total amount of all account payables and total amount of disbursements in the following categories: costs for printing and distribution of posters, printing costs for preelection announcements, statements and so on, in the public media, organizational and operational costs for organizing rallies, costs for printing, reproducing and delivering pre-election materials directly to voters, and 5. the amount and nature of outstanding debts and obligations owed by or to the person who files a report and where such debts and obligations are settled for less than their reported amount or value, a statement as to the circumstances and conditions under which such debts or obligations were extinguished.

(1) Politička stranka obavezna je imenovati ovlašteno lice koje je odgovorno za vođenje poslovnih knjiga političkih stranaka, podnošenje finansijskih izvještaja i koje je ovlašteno da kontaktira s Centralnom izbornom komisijom Bosne i Hercegovine. (2) Podnosilac izvještaja obavještava Centralnu izbornu komisiju Bosne i Hercegovine o imenovanju ovlaštenog lica iz stava (1) ovog člana u roku od 15 dana od njegovog imenovanja i u slučaju bilo kakve promjene statusa tog lica dužni su u roku od 15 dana obavijestiti Centralnu izbornu komisiju Bosne i Hercegovine o toj promjeni. (3) Ovlašteno lice potpisuje sve izvještaje i odgovorno je za vođenje evidencije u vezi sa izvještajima, a na zahtjev Centralne izborne komisije Bosne i Hercegovine, ovlašteno lice obavezno je dostaviti izvještaje na uvid. (4) Političke stranke čuvaju sve svoje finansijske izvještaje najmanje šest godina nakon podnošenja. (5) Centralna izborna komisija Bosne i Hercegovine sve izvještaje stavlja na raspolaganje javnosti putem svoje veb-stranice i preduzima odgovarajuće mjere da bi se osiguralo da svi građani imaju pristup informacijama koje su sadržane u izvještajima. (6) Politička stranka dužna je javno prikazati porijeklo i način utroška sredstava prikupljenih tokom protekle kalendarske godine (računovodstvene godine). Završni račun i finansijski izvještaj u kojem se podrobno navode izvori prihoda, podaci o fizičkim i pravnim licima koja su dala dobrovoljne priloge te podaci o namjeni, odnosno aktivnostima za koje su sredstva utrošena, javni su dokumenti i objavljuju se na veb stranici političke stranke.

(1) A political party is required to appoint an authorized person responsible for maintaining the party’s business records, submitting financial reports, and serving as the authorized contact with the Central Election Commission of Bosnia and Herzegovina. (2) The reporting entity shall notify the Central Election Commission of Bosnia and Herzegovina of the appointment of the authorized person referred to in paragraph (1) of this Article within 15 days of the appointment, and in the event of any change in the status of that person, it shall notify the Central Election Commission of Bosnia and Herzegovina within 15 days of such change. (3) The authorized person shall sign all reports and is responsible for keeping records related to the reports. Upon request of the Central Election Commission of Bosnia and Herzegovina, the authorized person is obliged to submit the reports for inspection. (4) Political parties shall keep all their financial reports for at least six years after submission. (5) The Central Election Commission of Bosnia and Herzegovina shall make all reports available to the public through its website and shall take appropriate measures to ensure that all citizens have access to the information contained in the reports. (6) A political party is obliged to publicly disclose the origin and use of funds collected during the previous calendar year (financial year). The final account and financial report, which detail the sources of income, information on natural and legal persons who made voluntary contributions, and data on the purpose and activities for which the funds were spent, are public documents and shall be published on the political party’s website.

Politička stranka i nezavisni kandidat koji učestvuju na izborima za organe vlasti Bosne i Hercegovine na svim nivoima će imati jedan račun za finansiranje izborne kampanje i dužni su, u  vrijeme podnošenja prijave za ovjeru za učešće na izborima, Centralnoj izbornoj komisiji BiH  podnijeti finansijski izvještaj za period koji počinje tri mjeseca prije dana podnošenja prijave za  ovjeru. Osim toga, u roku od trideset (30) dana od dana objavljivanja izbornih rezultata u   Službenom glasniku BiH, podnosi se i finansijski izvještaj za period od dana podnošenja prijave  za ovjeru za izbore do dana ovjere rezultata izbora.

(1) Centralna izborna komisija Bosne i Hercegovine nadležna je da ispita slučajeve u kojima nije postupljeno u skladu s odredbama ovog zakona i može određenim licima narediti da odgovore na pitanja u pisanoj formi da bi se osigurali dokumentirani i drugi dokazi, te pribavile izjave svjedoka u vezi sa istragom koju je eventualno pokrenula Centralna izborna komisija Bosne i Hercegovine. Centralna izborna komisija Bosne i Hercegovine može započeti istragu ili preduzeti odgovarajuće mjere samostalno ili po uloženom prigovoru. (2) Centralna izborna komisija Bosne i Hercegovine nadležna je za provođenje odredbi ovog zakona i nadležna je da odluči da li su politička stranka ili drugo lice prekršili odredbe ovog zakona, kao i da izrekne sankcije bilo kojoj političkoj stranci zbog nepridržavanja navedenih odredbi ili da preduzme odgovarajuće administrativne mjere u okviru svoje opće nadležnosti, u skladu sa zakonom. (3) Prije izricanja kazne ili preduzimanja administrativne mjere, Centralna izborna komisija Bosne i Hercegovine nastojat će postići da politička stranka, za koju je ustanovljeno da je prekršila odredbe ovog zakona, dobrovoljno otkloni uočene nedostatke, ako su oni otklonjivi. (4) Svaku sumnju o krivičnom djelu koje se može dovesti u vezu s finansiranjem političkih stranaka i finansiranjem izborne kampanje Centralna izborna komisija Bosne i Hercegovine obavezna je prijaviti nadležnom tužilaštvu i drugim organima nadležnim za provođenje zakona.

(1) The Central Election Commission of Bosnia and Herzegovina is authorized to examine cases of non-compliance with the provisions of this law and may order certain persons to provide written responses in order to secure documentary and other evidence, as well as obtain witness statements related to an investigation initiated by the Central Election Commission of Bosnia and Herzegovina. The Commission may initiate an investigation or take appropriate measures either on its own initiative or upon receiving a complaint. (2) The Central Election Commission of Bosnia and Herzegovina is responsible for enforcing the provisions of this law and has the authority to determine whether a political party or another person has violated the provisions of this law. It may impose sanctions on any political party for non-compliance with these provisions or take appropriate administrative measures within its general competence, in accordance with the law. (3) Before imposing penalties or taking administrative measures, the Central Election Commission of Bosnia and Herzegovina shall seek to ensure that a political party found to be in breach of the provisions of this law voluntarily remedies the identified deficiencies, if such deficiencies can be corrected. (4) Any suspicion of a criminal offense related to the financing of political parties and election campaigns must be reported by the Central Election Commission of Bosnia and Herzegovina to the competent prosecutor’s office and other law enforcement authorities.

(1) Finansiranje političkih stranaka zabranjuje se:  a) organima uprave države Bosne i Hercegovine, entiteta, kantona, BrčkoDistrikta Bosne i Hercegovine, te gradskim i općinskim organima,  b) javnim institucijama,  c) javnim preduzećima,  d) humanitarnim organizacijama,  e) neimenovanim, odnosno anonimnim donatorima,  f) vjerskim zajednicama,  g) sindikatima, udruženjima i drugim neprofitnim organizacijama koje se finansiraju javnim sredstvima bez obzira na iznos sredstava,  h) pravnim licima u kojima uloženi javni kapital iznosi najmanje 25%,  i) drugim državama, stranim političkim strankama i stranim pravnim licima.  (2) Zabrana iz stava (1) tačke a) ovog člana ne odnosi se na korištenje poslovnih prostorija, koje političke stranke koriste na osnovu odluke nadležnog organa.  (3) Izuzetno, zabrana finansiranja političkih stranaka iz stava (1) tačke i) ovog člana ne odnosi se na finansiranje programa namijenjenih za edukaciju, a s ciljem razvoja i promoviranja demokratskih principa.  (4) Privatna preduzeća koja su s organima izvršne vlasti na svim nivoima u Bosni i Hercegovini sklopila ugovor o javnoj nabavci usluga, ugovor o javnoj nabavci robe ili ugovor o javnoj nabavci radova, u skladu s propisima o javnim nabavkama u Bosni i Hercegovini, ne mogu finansijski pomagati političke stranke ako vrijednost ugovora u jednoj kalendarskoj godini prelazi iznos od 10.000,00 KM (deset hiljada konvertibilnih maraka).  (5) Političke stranke ne mogu ostvarivati prihode od imovine koja nije u njihovom vlasništvu.(6) Zabranjeno je davanje dobrovoljnih priloga u novcu ili u formi proizvoda posredstvom trećih lica (posrednika). (7) Eventualni dobrovoljni prilozi uplaćeni na račun političke stranke iz nedopuštenih izvora prema st. (1) i (6) ovog člana, kao i iznosi dobrovoljnih priloga koji prelaze iznose utvrđene u članu 6. ovog zakona, te eventualne uplate dobrovoljnih priloga od neimenovanih, odnosno anonimnih izvora, politička stranka dužna je uplatiti u korist budžeta BiH, najkasnije u roku osam dana od dana primljene uplate, te o tome obavijestiti Centralnu izbornu komisiju Bosne i Hercegovine.

Novčanom kaznom u iznosu od 500,00 KM (pet stotina konvertibilnih maraka) do 10.000,00 KM (deset hiljada konvertibilnih maraka) kaznit će se za prekršaj politička stranka koja: a) finansijska sredstva koristi suprotno odredbi člana 4. st. (1) i (2) ovog zakona, b) ne vodi evidenciju o prijemu članarina i dobrovoljnih priloga i ne izdaje potvrde o njihovom prijemu, u skladu s odredbom člana 5. stav (4) ovog zakona, c) se finansira podizanjem kredita kod banaka, u kojima je udio državnog osnivačkog kapitala veći od 25%. d) osigura sredstva iz izvora koji nisu propisani članom 3. ovog zakona, e) krši odredbe člana 9. ovog zakona, f) ne vodi evidenciju o svojim prihodima i rashodima u skladu s propisima, g) ne dostavi propisane finansijske izvještaje u skladu sa Izbornim zakonom Bosne i Hercegovine (član 12. stav (3)), h) ne podnese finansijski izvještaj u skladu sa ovim zakonom (član 12. stav (4)), i) ne dostavi dodatne finansijske izvještaje (član 12. stav (5)), j) ne imenuje ovlašteno lice koje je odgovorno za podnošenje izvještaja i ovlašteno da kontaktira s Centralnom izbornom komisijom Bosne i Hercegovine (član 13.), k) ne obavijesti Centralnu izbornu komisiju Bosne i Hercegovine u roku od petnaest dana od imenovanja ovlaštenog lica ili bilo kakve promjene statusa ovlaštenog lica. (2) Novčanom kaznom u iznosu od 200,00 KM (dvije stotine konvertibilnih maraka) do 2.000,00 KM (dvije hiljade konvertibilnih maraka) za prekršaj iz stava (1) ovog člana kaznit će se i fizičko lice koje izvrši prekršaj.

"(1) Financing political parties shall be prohibited to: a) State, entity and cantonal bodies, bodies of Brčko District of BiH, and city and municipal bodies, b) Public institutions, c) Public enterprises, d) Humanitarian organizations, e) Anonymous donators, f) Religious communities, g) Labor unions, associations and other non-profit organizations, which are financed by public funds regardless of the amount, h) Legal entities in which invested capital amounts at least 25%, i) Other states, foreign parties and foreign legal entities. (2) The prohibition referred to in paragraph (1), point a) of this article shall not relate to use of business premises, which are used by political parties pursuant to the decision of a competent body. (3) Exceptionally, financing prohibition referred to paragraph (1), point i) of this Article does not refer to financing educational programs, aimed at developing and promoting democratic goals. (4) Private enterprises that closed contract on public procurement of services, contract on public procurement of goods or public procurement of work with the bodies of executive authorities at all levels in BiH in accordance with the regulations on public procurement in BiH, cannot financially support political parties if the value of the contract in one calendar year exceeds the amount of 10.000,00 KM (ten thousand convertible marks). (5) Political parties cannot obtain any incomes from property that is not owned by them. (6) It is prohibited to give contributions in cash or in kind contributions through third persons (by a proxy). (7) Likely contributions paid from sources prohibited in paragraph (1) and (6) of this Article to the account of a political party, as well as contributions exceeding the amount set in Article 6 of this Article, and possible payments of contributions by anonymous sources, shall be paid to the BiH budget by a political party, no later than eight days following receipt of such contributions."

"A financial penalty in the amount from 500 KM (five hundred convertible marks) to 10.000 KM (ten thousand convertible marks) shall be pronounced for the violation to: a) a political party that used the funds contrary to the provision of Article 4, paragraph (1) and (2) of this Law, b) a political parties that failed to keep records on received membership fees and contributions and that failed to issue a receipt on received fees and contributions in accordance with provision of Article 5, paragraph (4) of this Article, c) a political party that is financed by obtaining a loan from banks; d) a political party that gets the funds from the sources that are not set forth in Article 3 of this Law; e) for violating provisions of Article 9 of this Law; f) a political party for failing to keep records on its incomes and expenditures in line with the regulations; g) a political party for failing to submit prescribed financial reports in line with the BiH Election Law (Article 12, paragraph 3); h) a political party for failing to submit financial reports in line with this Law (Article 12, paragraph 4); i) a political party for failing to submit additional financial reports (Article 12, paragraph 5): j) a political party for failing to appoint a person authorized to submit reports and to contact the BiH Central Election Commission (Article 13), k) a political party for failing to inform the BiH CEC within fifteen days following appointment of the authorized person or any other changes of the authorized person’s status. (2) A financial penalty in the amount from 200 KM (two hundred convertible marks) to 2.000 KM (two thousand convertible marks) shall be pronounced to a natural person for the offence referred to in paragraph 1 of this Article."
