Announcementand publication of referendum results
34.-(1) The Commission shall, on receipt of results of the referendum from all constituencies and
within seventy two hours from the close of the final polling in thereferendum-
(a) announce to the public the total number of valid votes cast supporting or opposing the referendumquestion as set out in the Second Schedule to this Act;
(b)declare whether or not the subject matter of the referendum has been ratified by more than fifty per cent of the valid votes cast for Mainland Tanzania andZanzibar;

(5) Where the majority of votes cast at a referendum is “YES” or “NO”, the valid votes cast shall be deemed to be the decision of majority of thepeople in relation to the question posed, and the government shall takeinitiative to implement or desist from implementing the decision of the question posed.

Referendumresults
41.-(1) The majority of valid votes cast in the referendum shall determine on such question of the referendum and the referendum results declared by the National Electoral Commission shall be binding on theGovernment of the United Republic and the Revolutionary Government of Zanzibar.
(2)The referendum results shall be decided on the basis of support by more than fifty per cent of the total number of valid votes cast in Mainland Tanzania and more than fifty per cent of the total number of valid votes cast inTanzania Zanzibar.
(3) Where the votes cast “YES” on a questionat a referendum are not more than fifty per cent of the total number of valid votescast in either Mainland Tanzania or Tanzania Zanzibar, the National Electoral Commission shall, upon collaboration with the Zanzibar Electoral Commission and by notice published in the Gazette, appoint another day, within sixty days after the declaration of the results, on which torepeat the poll and referendumprocedures shall commence afresh.
