PART IV – NOMINATION OF CANDIDATES

Objections to nominations

49. (i) A registered voter may object to a nomination paper on all orany of the following grounds, but on no other ground:

 (a) that the description of thecandidate is insufficient to identify the candidate;

(b) that the nomination paper does not comply with or was not deliveredin accordance with the provisions of the Constitution or this Decree;

(c) that it is apparent from the contents of the nomination paper thatthe candidate is not capable of being elected to the office to which hisnomination paper relates.

(2) No objection to a nomination paper shall be allowed unless it ismade to the ReturningOfficer between the hours of eleven o’clock in the forenoon and four o’clockin the afternoon on the day of nomination, provided that, if an objection isfiled a nomination paper may be corrected until five o’clock in the afternoonof the day of nomination.

(3) Every objection shall be in writing signed by the person objectingand shall specify the ground of objection

(4) The Returning Officer shall with the least possible delay, decide on the validity of anobjection and inform the candidate concerned of his decision in accordance withsection 46 or 47.

(5) The decision of aReturning Officer on nomination paper or any objection may be appealed againstin writing presented to the Commission within two days of the decision, and thedecision of the Commission, on such appeal shall be final and shall not becalled into question in any court of law.

(6) Nothing contained in this Part with respect to limitation of time orotherwise shall affect a decision of the Commission whether to accept or rejecta nomination paper.

(7) The Commission shall communicate its decision to the appropriateReturning Officer who shall act promptly on such decision.

Participation of political parties in election

104. (1) The conduct of elections to an electiveoffice in accordance with the Constitution and this Decree shall be based onparty politics.

Registration of political parties

105. (1) The Commission shall, on the written applicationof a political party in the prescribed for, register the party, if theCommission is satisfied that […].

 

109. (1) A political party which is aggrieved bya decision of the Commission to deny it registration or to de-register it may,within fourteen days of such denial or de-registration, appeal to the Court.

(2) The decision of the Court may be appealedagainst to the Court of Appeal whose decision shall be final.

Comment

No fee is mentioned in the relevant sections ofthe law covering appeals for nomination and registration. Thus we assume thereis no requirement to pay fees.
