A political party that is aggrieved by a decision of the Commission not to register it or to cancel its registration may, within 30 days after the party has been notified of the decision, appeal to the High Court against the decision.National Assembly Electoral Act, 2011:42Objections to nomination of candidate for elections in constituenciesAn elector or political party may lodge an objection in respect of any name that appears on the list contemplated in section 41.The objection referred to in subsection (1) shall be lodged - in the prescribed form;Within 5 days of the lodging of the objection, the Commission shall -(a)consider the objection;(b)make a decision on it; and(c)inform the objector and the person, against whom the objection is directed, of its decision in writing.(4)A person who is aggrieved by the decision of the Commission may appeal against the decision to the High Court.(5) The High Court shall hear and determine the appeal as expedi-tiously as possible and shall give its ruling at least 2 days before the date pre?scribed in the elections timetable for the announcement of nominations.National Assembly Electoral Act, 2011: 49Objection to nominations of candidates on party listAn elector, a political party registered with the commission, or the Director, may object to -(k)the submission of a list of candidates made in terms of section 47 on grounds that it does not comply with die requirements in that section; and(l)the nomination of a candidate on the grounds that the candidate is not eligible to stand as a candidate.(m)The objection shall be made in the prescribed manner by not later than the date prescribed in the elections timetable.(n)The Commission shall determine the objection and notify the objector and the political party concerned of its decision by not later than the date prescribed in the elections timetable.(o)The objector or the political party affected by the decision may appeal against the decision of the Commission to the High Court by not later than the date prescribed in the elections timetable.(p)If the Commission or the High Court decides that a candidate's nomination does not comply with the provisions of section 47, the Commission or the High Court may permit the political party an opportunity to comply with that section.
