New regulation (Decreto Número 26-2016) officially allows overseas voting in Guatemala for the election of the President and Vice-President. For the first time in the country’s history, Guatemalans who reside abroad were allowed to vote in the 2019 Presidential Elections.

Decreto Número 26-2016 del Congreso de la República el 25-05-2016.

Artículo 1. Se adicionan dos párrafos al artículo 12 del Decreto Número 1-85 de la Asamblea Nacional Constituyente, Ley Electoral y de Partidos Políticos, los cuales quedan así:

“Se instituye el derecho al voto en el extranjero a los ciudadanos guatemaltecos de conformidad con esta ley para elegir al Presidente y Vicepresidente. El Tribunal Supremo Electoral, con el apoyo de las instituciones del Estado a las que les sea requerido, realizará las acciones necesarias para garantizar este derecho; el voto en el extranjero se emitirá en la misma fecha que se fije para las elecciones en

Guatemala. En todo caso el reglamento específico que emitirá el Tribunal Supremo Electoral regulará todo lo relativo a la implementación del voto de los ciudadanos guatemaltecos en el extranjero.”

Article 1 of Decree 26-2016, which reformed the Electoral and Political Parties Law (LEPP), establishes that: “The Supreme Electoral Tribunal (TSE) with support from the state institutions to which this request was made will conduct the necessary actions to ensure the right. Out-of-country voting will take place on the same date as Election Day in Guatemala and in all cases the TSE will be charged with the enforcement of all rules relative to the implementation of the voting process for all Guatemalan citizens residing out of the country.”"
