Chapter 1 — Offences

37.

(5)  Aprosecution for an offence under this section shall not be instituted withoutthe consent of the Public Prosecutor

42. (2)  Aprosecution for a corrupt practice (except any corrupt practice as defined insubsection (1)(d) or (e)) shall not be instituted without the consent of thePublic Prosecutor.

(3) Without prejudice to section 38, every offence of undue influence orbribery under section 40 or 41, and every other corrupt practice undersubsection (1)(c), (d) or (e) shall be an arrestable offence within the meaningof the Criminal Procedure Code 2010 (Act 15 of 2010).

a fine not exceeding $5,000 or to imprisonmentfor a term not exceeding 3 years or to both

shall become incapable for a period of 7 yearsfrom the date of his conviction of being registered as an elector or of votingat any election under this Act or of being elected as the President or a Memberof Parliament.
