Article 39 Rights and obligations of the Public Prosecutor
(1) The fundamental right and duty of the Public Prosecutor is toprosecute perpetrators of criminal offences for whom prosecution is undertakenex officio.
(2) With cases of crime for which prosecution is undertaken ex officio,the public prosecutor has the right and duty to perform the following:
- Take the necessary measures with regards to discovering the criminaloffences and the perpetrators;
- Direct the actions to the authorities competent for discovering andreporting of criminal offences and their perpetrators;
- Propose and issue orders for undertaking special investigation measuresunder terms and in a manner defined by the Code herein;
