Article38. The Investigator

1. An investigator is an official person, authorized to conduct apreliminary investigation on a criminal case within the scope of competence,stipulated by the present Code.

 

Article 39. 1. The head of the investigation department shall beauthorized to: 1) entrust conducting a preliminary investigation to aninvestigator or to several investigators, as well as to withdraw a criminalcase from an investigator and to hand it over to another investigator with anobligatory indication of the reasons for such handing over, to form aninvestigative team, to change the composition thereof;

5. The powers of thehead of an investigative body specified in this Article, are exercised by theChairman of the Investigative Committee of the Russian Federation, heads ofinvestigating bodies of the Investigative Committee of the units, districts,and cities of the Russian Federation, their deputies, as well as heads of relevantinvestigative bodies of federal executive bodies (with the appropriate federalenforcement authorities), their territorial agencies in the units, districtsand cities of the Russian Federation, their deputies, heads of otherinvestigative agencies and their deputies, whose volume of procedural powersare determined by the President of the Investigative Committee of the RussianFederation, heads of relevant investigative bodies of federal executive bodies(with relevant federal bodies of executive power)
