77A Failure of member to comply with lawful request of presiding officer

(1) Where at a polling station a Act presiding officer requests theassistance of a member of the Jamaica Constabulary Force, the Island SpecialConstabulary Force, the Rural Prince or the Jamaica Defence Force who islawfully at that polling station in the execution of his duty and the memberwilfully fails to give such assistance, that member shall be guilty of anoffence and shall be liable on summary conviction before a Resident Magistrateto a fine not exceeding thirty thousand dollars or to imprisonment for a termnot exceeding three years; and the Resident Magistrate may, in addition to suchfine or imprisonment, order that the member be disqualified from carrying outany duties at any polling station and from being employed in any position ofelection officer for a period of at least seven years from the date ofconviction.

(2) Noproceedings under subsection (1) shall be commenced without the consent of theDirector of Public Prosecutions.
