CHAPTER 20ELECTION DISPUTES AND ELECTION PETITIONS

Presentation of ElectionPetitions

469. An election petitioncalling in question any election shall be presented to the Court prescribedunder section 467 or

468 within ten days from thedate of declaration of result in the constituency.

Provided that no electionpetition shall be filed before the

result of election in theconstituency has been declared.

 

Trial of Election Petitions

483. The trial of an electionpetition shall, as far as practicable and consistent with the interests ofjustice be conducted as expeditiously as possible and endeavour shall be madeto conclude the trial within one month from the date on which the electionpetition is presented to the Court concerned.

 

Election Appeals

512. Every appeal undersection 511 shall be preferred within a period of ten days from the date of theorder of the Trial Court.

Provided that the appellateCourt may entertain an appeal after the expiry of the said period of ten daysif it is satisfied that the appellant had sufficient cause for not preferringthe appeal within the period.
