Who can initiate an optional referendum at the national level?

Article109.
Uponthe proposal of the Cabinet and after receiving an advisory opinion of theSupreme Court, the President of the Republic may call a referendum on issues ofgeneral national interest, on a bill of an ordinary law, on a bill of anorganic law or decree relating to the signature of an international treaty oragreement which is not inconsistent with the Constitution but has repercussionson functioning of state institutions

Article107.
In the event of the death, resignation or permanentincapacity of the President of the Republic, the President is replaced in anacting capacity by the President of the Senate; in the absence of the Presidentof the Senate, by the Speaker of the Chamber of Deputies and in the absence ofboth, the duties of the President are assumed in an acting capacity by thePrime Minister.
The acting President of the Republic referred to in thisarticle shall not make appointments to public office, call a referendum,initiate an amendment to the Constitution, excercise the prerogative of mercyor make a declaration of war.
Thepresident can initiate a referendum at the national level, with exception tothe circumstance stipulated in article 107.
