There are clerical errors with references to the Constitution in Articles 3 and 6(1) of the Law on Organization and Conduct of the Referendum. The Constitution was amended in 2003, and four new articles were inserted as a result.

 

This resulted in the re-numbering of some articles: for example, “Article 152 became, in the republished form, Article 156.”

 

Article 3 of the Law on…Referendum states that the issues stated in Article 148 of the Constitution may not be subject to referendum. In the updated 2003 version of the Constitution, this corresponds to Article 152.

 

Article 6(1) of the Law on…Referendum states that constitutional revisions are carried out as defined by Articles 146 and 147 of the Constitution. In the updated 2003 version of the Constitution, Articles 150 and 151 define the procedure for constitutional amendments.

Title VII: Revision of the Constitution

Article 152: Limits of Revision

(1)The provisions of this Constitution with regard to the national, independent,unitary and indivisible character of the Romanian State, the republican form ofgovernment, territorial integrity, independence of justice, political pluralismand official language shall not be subject to revision.

(2) Likewise,no revision shall be made if it results in the suppression of the citizens'fundamental rights and freedoms, or of the safeguards thereof.

(3) TheConstitution shall not be revised during a state of siege or emergency, or inwartime.
