(Mandatory Referendum)

Article69.

(3) In so far as it alters Chapter II of thisConstitution, an Act under this section shall not come into operation unlessthe provisions contained in the Act effecting that alteration have, inaccordance with any law in that behalf, been submitted to a referendum in whichall persons who are registered as electors for the purposes of a generalelection shall be entitled to vote and unless those provisions have beensupported by the votes of not less than two-thirds of all the persons entitledto vote in the referendum.

Comment

Not all constitutional amendments are subjected to mandatoryreferendum. According to Article 69 of the Constitution, the Parliament(Maneaba) may ordinarily amend the Constitution with the support of 2/3 of itsmembers.  However, if the amendmentconcerns Chapter II (Fundamental Rights and Freedoms of the Individual) of theConstitution, article 69(3) stipulates the additional requirement: theamendment must be submitted to a referendum, and receive 2/3 of the support ofall persons entitled to vote.
