Article137: Dissolution of the House of Representatives

ThePresident of the Republic may not dissolve the House of Representatives except whennecessary by a causal decision and following a public referendum. The House ofRepresentatives may not be dissolved for the same cause for which the previous

Housewas dissolved.

ThePresident of the Republic must issue a decision to suspend parliamentary sessionsand hold a referendum on dissolution within no more than 20 days. If voters agreeby a majority of valid votes, the President of the Republic issues the decisionof dissolution, and calls for early parliamentary elections to take placewithin no more than 30 days from the date of the decision's issuance. The newHouse convenes within the 10 days following the announcement of the referendumresults.

Withregards to any treaty of peace and alliance, and treaties related to the rightsof sovereignty, voters must be called for a referendum, and they are not to beratified before the announcement of their approval in the referendum.

 

Article161: Withdrawal of confidence

TheHouse of Representatives may propose to withdraw confidence from the Presidentof the Republic and hold early presidential elections upon a causal motion signedby at least a majority of the members of the House of Representatives and the approvalof two-thirds of its members. The motion may only be submitted once for thesame cause during the presidential term.

 

Uponthe approval of the proposal to withdraw confidence, the matter of withdrawingconfidence from the President of the Republic and holding early presidentialelections is to be put to public referendum by the Prime Minister. If the majorityapproves the decision to withdraw confidence, the President of the Republic isto be relieved from his post, the office of the President of the Republic is tobe deemed vacant, and early presidential elections are to be held within 60days from the date the referendum results are announced. If the result of thereferendum is refusal, the House of Representatives is to be deemed dissolved,and the President of the Republic is to call for electing a new House ofRepresentatives within 30 days of the date of dissolution.

Article226: Amendment

Theamendment of one or more of the Constitution articles may be requested by the Presidentof the Republic or one-fifth of the members of the House of Representatives.The request specifies the articles to be amended and the reasons for theamendments.

Inall cases, the House of Representatives will debate the request within 30 days fromthe date of its receipt. The House issues its decision to accept the request inwhole or in part by a majority of its members. If the request is rejected, thesame amendments may not be requested again before the next legislative term.

Ifthe amendment request is approved by the House, it discusses the text of the articlesto be amended within 60 days from the date of approval. If approved by a two-thirdsmajority of the House’s members, the amendment is put to public referendumwithin 30 days from the date of approval. The amendment is effective from thedate on which the referendum’s result and the approval of a valid majority ofthe participants in the referendum are announced.

Inall cases, texts pertaining to the principles of freedom and equalitystipulated in this Constitution may not be amended, unless the amendment bringsmore guarantees.
