PART I Preliminary

5. (1) For thepurpose of filling a casual vacancy in the membership of the House of Assembly,the date on which the vacancy shall be deemed to have occurred shall, subjectto section 45 of the Constitution,

(a) in the case of death, upon the date of death;

(b) in the case of an election being declared void on an election petition, upon the date-of the certificate of theElection Court issued pursuant to the Election Offences and Controversies Act;

(c) in the caseof a person ceasing to be qualified to be a member of the House of Assembly orbecoming disqualified for any reason other than those mentioned in paragraphs(a) and (b), upon the date on which his office is declared to have been vacated,either by the Speaker or by the Court.

2.Interpretation

(1) TheInterpretation Act shall apply to these rules as  if they were an Act.

(2) In theserules-

 “ Court ” means the Supreme Court of Barbados;

”Judge”  means a Judge of the Court, and includes theChief Justice ;

Petitions

8. Form of petition.

Every petition shall be addressed “To the Supreme Courtof Barbados “. It shall bein the form set out in Appendix B to these rules with such variations as theparticular circumstances may require.
